Natalie says she wouldn't talk to Brooke, (and then does)

Brooke Adams has a new post up at her blog involving documents and the UEP trust, and people getting subpoenas in Texas.
It's essentially a teaser, advertising as many of her recent posts have, the possibility, or the near certainty that Brooke knows more than she's saying, now.

This little drama may play out before I have the chance to throw in my "swag" (Scientific Wild Ass Guess), but there was this interesting little tidbit:
The Plural Life - "(Natalie) Malonis told me on Thursday she had to check with Wisan to see what she was 'at liberty' to say. No answer yet."
My guess here is that if Wisan hasn't fired her yet, it's because it's the only way to keep her mouth shut, or hope to. It is more likely that whoever Texas Blues Man is, she has terminated that "attorney-client" relationship, unless of course Wisan is the Blues.

That's not a guess, that's rhetorical by the way, and somewhat amusing to speculate.

So much for Nat's claim that she wouldn't talk to Brooke.

So did Blues get a subpoena?
"(Patrick) Crimmins told me Friday no one in his department received a subpoena.

Earlier in the week, Jerry Strickland, a spokesman for the Texas Office of the Attorney General, gave me this statement when I asked about the dictations:

'Neither OAG nor law enforcement has made these documents available to the parties to the UEP Trust litigation.'

So who in Texas got the subpoenas?"
I wouldn't believe Patrick necessarily. He is a convincing liar, based on direct experience, and making the mistake of believing him. That's once Patrick.

But assuming it is true, as it is possible that no one got such a subpoena in Texas Government. Apparently from what Brooke is saying, someone did.

Jerry Strickland makes Patrick Crimmins more believable.

So is one of those someone's the Blues?

Mark Shurtleff must think he's a banker, or a judge...

A while ago he thought he was going to be a Senator.
KUTV - "In a letter sent to FLDS attorneys, Mark Shurtleff says the issue must be resolved within 30 days. He suggests following a proposal from Bruce Wisan, the accountant appointed by a judge to manage the trust."
The headline on the article says he's "demanding" this of the FLDS.

Who died and appointed him God? Last time I checked this was a matter for the courts.

FLDS wins a little battle in the UEP trust fight

They might win a big one after Monday. I had a "heads up" this was coming. It makes you wonder how people know.
The Salt Lake Tribune - "The order, signed by Justice Ronald E. Nehring, sets a deadline of Jan. 4 at 5 p.m. for responses to the petition filed by attorneys for members of the Fundamentalist Church of Jesus Christ of Latter Day Saints.

The order also extends the trust's right to repurchase heifers sold from the Harker Farm in Beryl, part of the United Effort Plan Trust, until a ruling is made on the petition. That sale was to be final on Dec. 31.

In a petition filed Monday, the sect asked for a stay of all proceedings and orders in the trust case and requested a schedule be set to hear claims that members' religious rights have been violated in the court-sanctioned reformation and management of the trust."
Anti FLDS forces seem to be losing their grip on the process which is being transparently manipulated by judges that of course, are supposed to be impartial, but aren't.

But we'll see after Monday, the deadline for response to the FLDS request.

Allen Steed has had enough of Elissa Wall

What you wanna bet Dan Fischer is the Highest Bidder?

Or maybe one of the highest? Depleting the cash resources of the FLDS? The Berry Knoll sale is approved to the highest bidder by the Judge.
KSTU/AP - "A Utah judge has ordered the sale of a 400-acre parcel of land that is part of a trust established by followers of jailed polygamous sect leader Warren Jeffs. In a ruling issued Monday, 3rd District Court Judge Denise Lindberg says a liquidity crisis of the United Effort Plan Trust makes the sale of Berry Knoll necessary.

Her order calls for the northern Arizona property to be sold to the highest bidder."
This should be interesting to watch, and heinous as well.

The Tribune Switches Sides?

Sensing (perhaps) that there is a big story about to be told without them concerning the UEP trust, the Salt Lake Tribune goes from the studied every so subtly "anti FLDS" detachment of Brooke Adams, to the outright advocacy of Rebecca Walsh. The following appears in today's edition of the Salt Lake Tribune, in the Polygamy section:
"This week, the attorney general and lawyers for the Fundamentalist Church of Jesus Christ of Latter Day Saints working on a settlement discovered Wisan's $360,000 fire sale of cow flesh in a footnote filed in court. Wisan's last-minute deal smells bad."
I'll say. But for years it's been merely reporting the claims of the FLDS and their attorneys that Wisan was a thief, now with the carcass of his bad deals showing up undeniably in court, the Tribune finds a voice and chimes in, clearly on the side of the FLDS. It makes you wonder, when will someone move off the fence in the case of the raid? Must there be an Island Pond smoking gun discovered? Flora Jessop meeting with David Doran, Bruce Long, Barbara Walther, Becky Hoerth and Rozita Swinton and Flora saying: "Now, here's my plan..," all on video tape?
"Attorney for the FLDS Rod Parker believes Wisan is trying to derail the settlement to keep his expensive gig going. Meantime, he says, the trustee is cannibalizing the FLDS assets.

'It's gotten to the point where the fiduciary's not answerable to the attorney general anymore. He's vastly outpaced his mandate,' Parker says. 'If the FLDS had sold $360,000 of cattle under the table, there would be hell to pay. There should be hell to pay for the fiduciary.'

At the same time, Wisan is fighting charges of trespassing in Arizona after his employee entered two homes in Colorado City without the residents' permission.

It's good to see the Tribune reporting (finally) but what ever happened to the reporter that went out and found a story, as opposed to the cheerleader reporters we have now, that call the game forensically, from the sidelines?

There's sufficient evidence out there to ask the questions and tell the story of what really happened leading up to the raid. If reporters wait until it's presented as an exhibit in court, we can all kiss our freedom goodbye.

How is the UEP trust like YFZ's children?

Because after much strife, many dollars and lots of accusations, the state of Utah is going to give UEP back to the FLDS.
The Dallas Morning News - "(T)he proposal returns control of most of the trust holdings to the Fundamentalist Church of Jesus Christ of Latter-day Saints.

An arm of the church, the United Effort Plan Trust holds most of the land and homes in Hildale, Utah, and Colorado City, Ariz., the twin towns where most church members live, and a church enclave in Bountiful, British Columbia.

The Utah courts seized the communal trust in 2005 after allegations of mismanagement by Jeffs. Under the oversight of a court-appointed fiduciary, the communal religious trust has been converted into a secular entity."
This is the state of Utah's plan. So remind me. Why did they take control of the trust in the first place? Never mind...

What happens on a Friday afternoon? News you want to hide.

All that bluster about not taking the payment "under protest."
KIFI/(AP) - "A court-appointed fiduciary has reversed a decision to reject a check for past-due housing fees from a southern Utah polygamous church.

Bruce Wisan initially rejected the Monday payment of $192,600 made "under protest" by the Fundamentalist Church of Jesus Christ of Latter Day Saints.

The fees are half of what's owed in occupancy fees on homes in Hildale, Utah, and Colorado City, Ariz. The homes are held in the church's United Effort Plan Trust."
Bruce did get his pound of flesh, a statement saying that the FLDS didn't plan to sue.

FLDS Money "not accepted."

It's not enough for the FLDS to pay, they must pay acknowledging that Bruce Wisan is Goddess Almighty.
Hildale, AZ - "The Fundamentalist LDS Church paid a $192,600 bill to the Utah Attorney General's Office, but said it was doing so under protest.

Because of that, the accountant appointed by the courts to oversee the polygamous sect's real-estate holdings arm refused to accept it.

'My attorneys would not accept it under protest,' Bruce Wisan, the court-appointed special fiduciary of the United Effort Plan (UEP) Trust told KSL NewsRadio late Monday. 'That's a legal term I think it has to do with the right of them to go back and make a claim against the funds.'

The southern Utah-based polygamous sect said it paid the bill after a judge in Salt Lake City's 3rd District Court ordered it to or she would lift the stay on massive litigation over the UEP Trust."
The words that come to mind regarding Ms. Wisan? "Whining Attention Whore."

FLDS pays up

I follow but don't remark on the trust dispute in Hildale and Colorado City (Short Creek). It's not because I don't care about the issue. I view it as part of the "assault on all fronts" policy that various state and federal agencies have brought against the FLDS to destroy them.
KPVI-Salt Lake City (AP) - "A southern Utah-based polygamous group is meeting a judge's demand to pay $192,600 in past due fees on houses held in a court-controlled church trust.

The Fundamentalist Church of Jesus Christ of Latter Day Saints says it made the payment Monday afternoon. The sum is half of what is owed for six months of occupancy fees on homes in Hildale, Utah, and Colorado City, Ariz."
So they dodge a bullet. Good for them. I'm sure there are a lot of disappointed enemies. It's hard to comment on the issue because I expect this sort of relentless hammering and assessment of expense. Who's bleeding who?

Having your homes taken from you. The people speak.

Periodically, I feel called upon to add the disclaimer that this blog does not endorse the FLDS faith. What I do endorse is their right in this constitional form of Government, to own property in the way they see best, and to practice their religion. These are reserved, polite people that are articulate and are within the self imposed restraints of what they see as good behavior, passionate.

I am not FLDS and never will be, but in being Orthodox Presbyterian, I need protections, or at least would enjoy protections that if granted to me, are consquently granted to the FLDS as well. For that reason, despite my religious differences, which are vast, I support them and will continue to do so. Hat tip to Brooke Adams, at the Plural Life.
