Delay, Delay, Delay Machine back up and Running for Rozita?

According to Douglas County, whose computers have been down most of the afternoon;
Rozita's case was "vacated" for tomorrow. The individual answering the phone could not tell me if that meant her case was dismissed, or if the probation revocation hearing had been reset for another time.

Douglas County says no, "Charges against Rozita have not been dropped."

There is a revocation hearing set for January 27th, 2010.
Douglas County - "Charges against Ms. Swinton in Douglas County were not dropped and there is a pending Probation Revocation hearing set for January 27."
I have a tendency not to like David Foley, as he is on the "other side," but that's superficial. He grand stands a bit, but he hasn't been wrong yet. The money says whatever Douglas County does, will be inconsequential. You have to figure if they just let it slide, not giving Rozita any jail time, it becomes someone else's problem, namely, El Paso county. The time is set for 1:30 pm.

Douglas County Drops charges against Rozita

I don't know how you can "drop" a charge that a person has already plead guilty to, but according to the Colorado Springs Gazette, Rozita isn't going to face the music in Castle Rock:
The Gazette - "As part of the plea, authorities in Douglas County have also agreed to drop charges stemming from a similar false reporting incident in 2005, (DDA Frederick Stein) said."
Mr. Stein also characterized the verdict as "fair." What's he going to do, say he was taken out back, had his arm ripped off and he was beaten nearly to death with it? It's one of those "Too Heavy, Too Light" questions.

There are a number of errors in the article, not the least of which is Rozita's age (she's 35 now) and her middle name is misspelled. She snuck in through a side entrance after El Paso county lied and stated her case had been "called off" that day.
"Swinton was barely audible in the courtroom as she said a few words during the 30-minute hearing to indicate that she knew she was waiving her right to a trial."
Her attorney had the audacity to suggest that she did a good thing:
" 'I believe the phone call in Texas resulted in the prosecution of some people who were sexually assaulting young women,' Foley said. 'If anyone felt that Ms. Swinton was involved in that, that’s a good thing.' "
He's portraying his client as a heroine, and daring anyone to sentence her to anything, and perhaps reminding Texas that he may know something.

I was apparently wrong about her employment status, though she has hobnobbed about the country a bit over the last year and a half, she still works it would seem, for State Farm Insurance.
"Foley said the case took longer than most misdemeanor cases because of his client’s medical issues. She was evaluated by doctors in advance of the plea and prosecutors had their own experts review those reports.

Foley described his client as 'a real sweetheart' who has held a job with an insurance company for the last 10 years. He said she declined comment on the case."
And she is to stay in Colorado:
"(Rozita) is not allowed to leave Colorado without the court’s permission."
An attempted murder, that's one way of looking at it, attempted murders actually, over about 500-600 people at YFZ, had it ended similarly to Waco. A real sweetheart alright.

Jerry Strickland says David Foley is full of Smoke (and YES, Rozita will serve NO time)

We're not finished with the investigation, says the Texas Attorney General's office:
"Jerry Strickland, spokesman for the Texas Attorney General, told the Houston Chronicle today that the state's inquiry 'into Rozita Swinton and other aspects of this case is ongoing.'

Swinton, of Colorado Springs, was considered a 'person of interest' in connection with calls to a hot line alleging abuse at the Fundamentalist Church of Jesus Christ of Latter Day Saints' ranch in West Texas."
Oh, I believe David Foley, as he has not lied to me yet. How long does it take, JERRY? It's been almost TWO YEARS.

This interesting little tidbit is also included:
"Swinton was also sentenced to 45 days in jail but given credit for time served, so she faces no further jail time."
She didn't show for trial, Foley entered her plea (apparently) and she won't be showing up in jail.

The Salt Lake Tribune added this detail:
"The judge also limited her to one landline telephone and one cell phone and ordered her to give both numbers to the district attorney's office."
I wonder if she will continue to be able to use a computer, to access the internet? According to her "MySpace" pages, she was on yesterday.

Still unanswered? What happened to her deferred sentencing arrangement in Douglas County for her 2007 conviction of false reporting?

Dirty Deals Done Dirt Cheap - Rozita Swinton Pleads Guilty (UPDATE, will apparently serve no time)

The trial day shift was a technical matter, or a ruse, in any case, she has pled guilty. It also appears from the AP story on the subject, that everything is linked to Texas dropping any interest in charging Rozita:
Deputy District Attorney Frederick Stein, El Paso County Colorado - "Ms Swinton entered a guilty plea which was just completed 10 minutes ago. She plead guilty to a charge of false reporting to authorities and received a 2 year deferred sentence with several conditions."
This is also being reported by KRDO:
COLORADO SPRINGS - "35-year-old Rozita Swinton avoided trial by pleading guilty on a charge of false reporting (today).

Swinton made multiple fake calls to police in Colorado and Texas. She was accused of making a phone call to police in February of 2008, claiming she was a girl named Jennifer and was hurt and trapped in a basement. Police went door-to-door searching homes for hours, looking for the girl. The call turned out to be a hoax.

The judge deferred sentencing for 2 years, but he is still requiring her to serve 45 days in jail
.

Police turned their focus to Swinton, when Texas Rangers traced a call to her, following the raid of a polygamist compound in April of 2009. In that case, a girl named Sarah told a social worker she was trying to escape the religious sect. Swinton has not been charged in that case."
I have contacted Douglas County to see how this affects her deferred sentencing agreement there. It may be that in delaying Rozita's trial as long as it has been delayed, that Douglas County no longer cares. I'm not sure how those sorts of things work, but hypothetically if her "deferred sentencing" in Douglas County stated "Don't Get Into Trouble" for 4 years, and those 4 years were up, she could then become convicted in El Paso County, and keep her Douglas County deferred sentencing agreement intact. The story errs in assigning the date of "April 2009" to the raid, which occurred in April of 2008.

It turns out that Rozita may not even go to jail, despite what it says above:
KKTV - The attorney for Rozita Swinton entered the plea on her behalf (this) morning to false reporting charges. In February 2008, Swinton started calling Colorado Springs police, telling them she was a 16-year-old girl trapped in a basement. The calls triggered a massive and frantic search in the northeast side of the city. Swinton allegedly also made calls to TESSA, a local group that helps domestic violence victims.

- Swinton was handed a 24-month deferred sentence. She received 45 days jail time but the judge gave her credit for time previously served in treatment.
Also it would seem that she did not even show up.

The Associated Press had this take on the story:
COLORADO SPRINGS, Colo. (AP) -- "(David Foley), attorney for (Rozita Swinton) says Texas authorities don't believe she had any 'criminal involvement' in telephone calls that triggered a raid on a Texas polygamist group.

Rozita Swinton of Colorado Springs was once considered a 'person of interest' in connection with calls to a hot line alleging abuse at the polygamist compound in Texas.

(According to her attorney), she won't face charges in that case. A spokesman for the Texas attorney general didn't immediately return a call.

In an unrelated case, Swinton pleaded guilty in Colorado Springs today to misdemeanor false reporting. The judge ordered her to get medical treatment but did not specify her condition."
It appears that we were just waiting for the Dirty Deal in Texas to be done.

What happens to the evidence that Texas took? Rozita's computer and cell phones?

I have been roundly ridiculed for connecting the cases, but it now seems that Texas has been talking to David Foley on Rozita's behalf. This is so dirty.

Called Off (UPDATED) Rescheduled for FRIDAY (the 15th and then back to today)

She plead guilty. no word on if it was just another delay, plea deal or outright dismissal.
Up until yesterday afternoon, El Paso county was saying the trial would be today at 9am MST (one hour from the time of this posting).

Sometime late yesterday or yesterday evening, the "Call off" appeared on the El Paso county "Call Off" list for January 13th. At the moment of this posting, that would be a "tomorrow" list, though that will change to "today" sometime later this morning.

You have to remember, she was caught, by the POLICE, RED HANDED. The documents in that trial, of this "friend of CSPD" were sealed then.

UPDATE - See above, she plead guilty. All blog reports were accurate representations of what was from the El Paso county website, and also confirmed by phone calls. It appears Frederick Stein and David Foley colluded a bit to throw off potential spectators and media coverage.

It's a MIRACLE!! Rozita's "Pre Trial" conference actually TOOK PLACE, Trial Tomorrow

According to El Paso County, Rozita's court dates are now actually taking place.
Trial is set for tomorrow. A warning to anyone who is trying to attend that trial. The Judge is Daniel Scott Wilson, write that down. The courtroom is "Room C." I am told there is construction going on over there and they may move the trial to another room. If you're planning to attend, show early, ask questions, have the judge's name.

Representing the State (last time I checked) is Deputy District Attorney Frederick Stein. Representing Ms. Swinton, "Exclusively CRIMINAL" Defense attorney David Foley.

If you were thinking of showing up at Rozita's pre-trial conference tomorrow, don't.

At the last minute it has been moved from 9am tomorrow:
Frederick Stein/El Paso County District Attorney's office - "The pre-trial readiness date has been moved to Jan 11th at 9:00 am at the request of the defense and the prosecution. The trial date on Jan 13th remains the same." 4:14 MST.
I really don't think they want anyone showing up. Who knows, maybe they'll move it back now, at the last second. It's not on the "Call off" list for El Paso county and wasn't the last time either.

Once again, there is every evidence to suggest this is the oldest misdemeanor case in El Paso County that is being actively pursued. This means it's also approaching the record for "most delayed" as well.

There's only one question in both instances really.

Age and El Paso County Misdemeanor Prosecutions

I have made the claim that El Paso County is pursuing very few if any older cases than that of Rozita Swinton.
In recent months I can recall no cases where there were any 2008M classified cases on the "Call off" list of the 4th Judicial District.

Traffic cases are designated "T" and criminal cases are designated "CR" preceded by the year of the charge being filed. Traffic and criminal cases do not count.

As you can see here, after several conversations with El Paso county, there are now some misdemeanors that do show up as "Call offs." If a case is set for trial, as it must periodically be, to retain eligibility for prosecution, it is either tried, or called off and reset for prosecution at a later date. This must be done with the concurrence of the defense.

The above highlighted cases in red bold type, confirm the existence of misdemeanor cases as El Paso county contends, from 2008. Sometimes you wonder if you stirred the pot a little and if it affected what is being listed at the 4th Judicial districts site, nevertheless, there they are.

Rozita's case is C021 2008M 002726. As I understand the case numbers, they are assigned sequentially. The last 6 digits are the case number, which makes provision for about a million cases in El Paso county. I'm sure they don't reach that number.

Rozita's case is 2726, meaning there were 2725 cases before her. I assume most to be traffic tickets and other citations. Since it is assumed that she was charged in 2008 at the beginning of March or end of February 2008 for her hi-jinks in Colorado Springs, it means there are roughly 1000-1500 cases a month that are processed. The remaining cases showing up in the 7 day call off list for the 4th Judicial district are numbered 3493, 8283 & 9851. 3493 was charged, I would assume, approximately 2-4 weeks Rozita's was charged.

This still leaves her as the "oldest misdemeanor case" being "pursued" in El Paso county by all available evidence. This is not to say tomorrow another case might show up and blow her out of the saddle as reigning procrastinated prosecution, but she's firmly in the lead.

El Paso county for it's part blusters that it has "many" misdemeanor cases from 2008 that it is still pursuing, but mumbled in process of that declaration the word "traffic." Those would be 2008T cases, not 2008M. All the 2008M or prior cases called off for the next 7 days, appeared on TODAY's "call off" list.

(Case shown in bold green is the newest numerical prosecution, 12789. This would mean through about 10 months around 1300 or so cases are started in El Paso county's 4th Judicial district. It is a traffic violation.)

El Paso County Responds, Rozita to be tried NEXT YEAR.

I called, and I emailed Frederick Stein, Senior Deputy District Attorney for El Paso County Colorado.
This is my letter, to him:
"Mr. Stein,

I have several questions with regard to the Rozita Swinton case, that continues to be delayed. From where I stand this seems to be the oldest misdemeanor case in El Paso county, at this time.

Are you aware of the recently concluded CSPD IA investigation regarding Lt. Magdalena Santos and her well known (around CSPD) association with the defendant?

Are you aware of a statement made by Becky Hoerth, Rozita's former roommate in which she states that Lt. Magdalena Santos (980D) and Lt, Jane Anderson have interfered in a case or cases involving Rozita before, in her favor? This 50 page statement appears to have been generated in the first half of 2008, probably in April.

Are you aware of Rozita being used as "voice talent" for CSPD/CBI (and possibly FBI) internet sex sting operations that drew in suspects from across the Western United States? CSPD in conjunction with a task force was using phone contacts with leads picked up on the internet in which adults successfully portrayed themselves as little girls, to lure in predator suspects.

All of this looks terribly suspicious in view of the fact that the defendant sparked the largest child custody case in US history last year and in view of the fact that her attorney, former El Paso county prosecutor David Foley rather loudly stated he had "surprises" regarding the case in April of last year, a week after Rozita's arrest.

Can you let me know what is going on with this case and when it will next be on the court's calender?

If you go there, go to this page, it will be under "View Cases For Tomorrow" until sometime this morning, then it will revert to "View Today's Cases." "Called Off" does not mean "it will never happen," at least TECHNICALLY it doesn't mean that. It means IN THEORY it is being rescheduled.

UPDATE: Judging from the case number, Rozita's case originated in 2008. The "M" after "2008" appears to does designate "Misdemeanor." On the whole page of 7 day call offs, there is only one case from 2008 that is a misdemeanor that is still in play in El Paso County. Rozita's. Don't tell me this is normal, this is highly unusual.

Meanwhile, back in Colorado....

Here's a first. Rozita's pre-trial conference is NOT on the "Call off" list for today in Colorado Springs.
There is nothing to say that it might not appear later, or that at the pre-trial conference, more delays are in the offing, but she's not on the list today, which may mean she's actually there. You can look yourself, but only until about 9am tomorrow when it's updated to show Thursday's "Call Offs." If you recall, her trial is set for November 10th.

A fundamental reason Rozita's trial is being delayed.

There is supposed to be, this deposition.
A deposition that NO ONE on the defense side of the FLDS equation, knew about.

Well, they do now.

Thanks to a poster on the other side (everyone's good for something you know), It dawned on me. I've been saying that Rozita's relationship with Maggie Santos and her "partner," wasn't on the record.

Well, actually it was, in this "deposition."

As soon as the trial starts, don't those things come out? In the process of defending his client, David Foley would point out the relationship of Maggie Santos and Rozita Swinton (and Maggie's partner) and who knows who else.

So the trial is delayed, and delayed, and delayed, and delayed.

I'd say that's pretty plausible, because once the trial starts, it's now on the record, for everyone. That's why the FLDS trials in Texas have to start, before Rozita is tried. Sounds plausible. Doesn't it?

If the plausible is the actual, there are a lot more people involved in covering this up because you don't delay trials for the reasons given about, without someone's participation and/or appreciation and/or request and/or a quid pro quo.

Sorry Rozita, if I'm right, I just took away a trump card. I hope you have others. Like maybe someone asked you to call.

If all of the above is TRUE. Texas probably knows about the deposition, and has withheld that knowledge, from the defense.

Rozita, David Foley, Maggie Santos and Surprising things left unsaid.

Rozita's attorney David Foley has been confident from the beginning, boldly swaggering and making public statements, accurately predicting the future, and then, saying nothing more. Listen to what he said, one week after Rozita was arrested:
The San Antonio Express-News - "Texas Rangers accompanied Colorado Springs police officers last week when they searched Swinton's apartment, where they found items indicating a possible connection between Swinton and calls regarding the Eldorado compound. Swinton, who works for an insurance office, is free on $10,000 bond. Her attorney, David Foley of Colorado Springs, said he could not discuss the allegations.

'There's a lot more to this than the public is getting. I think people would be surprised. Stay tuned,' Foley said.

Her initial court appearance is set for May 1, but Foley said he expects the case will be rescheduled."
Not only did someone probably pay cash for Rozita's bond (I checked) but David Foley is ALREADY saying the case will be delayed (has it ever been) and publicly trumpeting in the press that they should "stay tuned" because he thought "people would be surprised."

He's said exactly zero after that. You can't catch David Foley. He's casually skipped court dates and had arrest warrants sworn out for his client that were later dropped, his client has traveled the country after being listed as a flight risk in the warrant (probably routine, I grant you), she has received expensive psychiatric care out of state and she has skipped in and out of the court confidently, right under the noses of the press with last minute changes in venue.

You'd think she was a rich celebrity client.

She's not. She's a simple misdemeanor defendant.

So David Foley was right, his client did get a delay, and a delay and a delay and a delay and who knows how many other delays.

Why DO you go out and say that you've got surprising things to say and then not say them and then get everything you want?

Could it be because you've got surprising things to say, and you're not saying them?

Rozita's Pre Trial and Trial Dates (UPDATED)

In Colorado Springs, a Pre Trial Conference on October 28th.
Trial is set for November 10th. This places the trial probably after rulings on YFZ evidence and quite probably after a decision is made on Allen Steed's claim that Elissa didn't report her "rape" in a timely fashion. (Since Allen's date is now set for December 3rd, I smell another delay.)

I continue to think that her attorney plays this so that no one looks bad, if she's simply turned loose with some sort of deferred prosecution. What Rozita did is not that bad (in terms of legal classification) but Texas refuses to prosecute her for her false reporting there, and mostly likely will not. Colorado doesn't know that though, and doesn't want to be shown as letting her off easy. David Foley, her attorney, knows that if all the FLDS cases are progressing without impediment, he can probably just get her turned loose.

As you can see, Rozita has a pre-trial conference scheduled two days after it should be known, at the latest, how Walther will rule on inclusion of the YFZ evidence. What you wanna bet it's delayed again?

Shoot YOURSELF in the leg, go to jail for two years and lose a lucrative income. Kill dogs (done regularly overseas for dinner), lose lucrative job, go bankrupt, lose even more lucrative endorsements, go to jail for two years. Threaten 439 kids and narrowly miss killing them?
Write blog posts about how the FLDS are brainwashing children and abusing them. At least, the blogger puporting to be Rozita does.

All of this suggests that this scheduled probation violation hearing, at least didn't go against Rozita. Look down the page about half way, she's right next to Plaxico (What 2nd Amendment rights?) Burress.

You really can't depend on the Colorado Springs Gazette which has taken a yawning attitude towards it's currently most famous adoptive daughter. They've done two stories on her, both sourced from the AP in the last year. Some local reporting.

It now looks as if the Ruling of the Suppression of Evidence is probably going to come this Friday. (Why Mr. Pharisee would it be this Friday? Because it's a long holiday weekend and it'll get buried!) Either that or as has been suggested by Anti FLDS forces, Walther will rule on the evidence suppression in each case individually as they come up in trial. This is important because of my predictive rule on FLDS related cases:

If Warren is snugly in jail on felony rape for a while, panic eases for the prosecutions in other venues because he won't be going anywhere. Avoidance is less necessary for Texas with regard to Rozita, and they may choose to dismiss her 'minor' misdemeanor case as Utah and Arizona already have, without much investigation, Rozita then can say she didn't violate her probation with the call to YFZ in April of 2008 and she doesn't have her deferred sentencing deal processed, and goes free. So expect David Foley to try to delay things again. It's his specialty in Colorado Law."
Allen legally flipped off the prosecution this year, just like he did a year ago, but this time upped the ante, chosing to go for outright dismissal of the case based on the statute of limitations.

Since nothing, no report at all, came out of the probation violation hearing last week, I'm guessing (that's guessing, not absolutely stating) that we have another trial delay on tap for Monday. Seriously, was this ever a real trial date? Starting a trial the week BEFORE the Labor Day Weekend?

Only a few things only can come out of such an inconvenient date. Another delay, or some form of deferred sentencing agreement, dismissal or plea bargain. It is kind of hard to plea bargain down the extremely minor charge Rozita already faces. But again, Rozita has brought a gun to a knife fight, continues to manuever in the court system better than Bernie Madoff did and will probably delay this all, again.

Texas must resolve it's issues, before Rozita can resolve hers. Utah must resolve their issues too. So must Arizona.

Told you So, Rozita's Trial delayed again, until August 31st

Why not just be honest and say "never?" What's the big deal? It's a misdemeanor trial, yet it is being delayed like a celebrity murder beef.
I of course reminded you of her high priced legal help yesterday, and expressed my doubts the trial would take place.
The Deseret News - "During a hearing in a Colorado Springs court (today), court records show the trial for Rozita Swinton, 34, on a charge unrelated to the Texas raid was vacated and rescheduled to begin Aug. 31. Swinton is charged with a misdemeanor count of false reporting, accusing her of pretending to be a sexually abused teenage girl in Colorado Springs who was chained in a basement."
Last week I spoke of the predictive mechanism I use for determining when it is that Rozita's trial will be scheduled and why. I may be wrong about the motives of her attorney and those behind the scenes, but isn't it odd that it serves as a perfect predictor of what will happen.

David Foley won't try Rozita's case with Allen Steed's case up in the air. He wants to see what happens there first. Foley wants the evidence situation resolved in Texas and Arizona regarding the FLDS raid, and he wants to know if Allen Steed will be convicted of rape. He will twist and maneuver to make sure his client never goes to court before these story lines play out.

Foley wants no chance of Swinton being asked in court if she made the phone call to YFZ, which would of course, be a violation of her deferred sentencing arrangement. You can believe completely that Rozita will get off entirely of her Colorado charges, if the ones in Texas become moot. The deal is already made, they just can't announce it until the dust settles, so they put the trial that will never happen off, again, and again and again. If someone wants to know what Rozita knows, they'd better sue her.

What's the big deal? How is Rozita harmed by a mere misdemeanor conviction? That she could easily live down. It's just that no one can know, if Texas can help it, what Rozita knows.

Why does an attorney oriented exclusively to Criminal Defense, take up the cause of a misdemeanant? Where did the money come from? What are they afraid of?

Rozita is a lifetime renter that let her Kia get impounded and junked. She then gets the big gun lawyer to smash a spider. He has succeeded in obtaining delay after delay after delay, and MAYBE something will finally happen next Tuesday. Maybe.

Allen Steed gets a "Resolution Hearing" set for June 25th

The only report that I can find is a "Twitter" by Brooke Adams.
This is an odd sort of legal phrase to associate with rape, at least to my knowledge. It generally shows up in family law matters, not when you're accused of a felony. So I venture this article I found on "Resolution Hearings" as it relates to family law, to see what might possibly be going on. Attorney Jo Spain (Family Law):
"If an agreement can't be reached then you will go into Court and your representatives will put forward their cases. No evidence is given but your representative will summarise your position and explain what you are seeking. If either side has made a 'Without Prejudice' offer then these will be shown to the Judge.

The Judge will have read all of the documents already filed and after hearing your representatives will indicate what he or she would order if this were a final hearing. There is no order made but this does mean that you will both hear what may well happen if this went to a final hearing."
The phrase, "Without Prejudice" is explained this way:
Wikipedia - "In many common law jurisdictions such as the United States, the U.K., Ireland, Canada, Australia, New Zealand and Singapore, the term 'without prejudice' is also used in the course of negotiations to indicate that a particular conversation or letter is not to be tendered as evidence in court; it can be considered a form of privilege. This usage flows from the primary meaning: concessions and representations made for purpose of settlement are simply being mooted for that purpose, and are not meant to actually concede those points in litigation."
Essentially, Judge Beacham is asking both sides in the Steed case to tell him how far they might go. I've heard a judge ask what the status of the jury was before, in a deadlocked deliberation. He was trying to get a feel for there being any possibility of a verdict.

Similarly Judge Beacham is sounding for potential common ground. If for instance Allen Steed were willing to plead to the lowest felony form of sexual intercourse without consent, and the prosecution were willing to make a plea bargain to the effect of some type of related misdemeanor, the Judge could signal both sides that resolution was possible, but would not tell either side how far the other was willing to go. There would be some hint though if the prosecution were willing to plead out the case to a misdemeanor, and were told that there was possibility of resolution, they would know that at least Allen would go as far as their worst case offer, "worst case" being from the prosecution's point of view, namely, that they weren't getting much of a conviction.

Anyway, that's how I see it. Allen's case has not shown up on the St. George/Washington county calender yet, but I'm sure it will. A similar flurry of activity occurred about this time last year with Steed's attorney's ending up telling the prosecution to go get bent.

I also see this sort of movement as an attempt to flush out related activity. In the past when these "minor" but related cases move in one state, another moves in yet another state. Rozita Swinton for instance is not yet charged with anything in Texas, and has a trial date of the 19th (this month) set in Colorado on an unrelated charge. Expect her attorney to play the "wait and see" game again if he can, and delay her appearances to late June or July.

Rozita goes to trial May 19th. Was she at the "Federal psychiatric facility in Missouri?"

Keep in mind the charges are unrelated except as to type Read on also to see Swinton's attorney brag his "firm is exclusively a criminal defense firm."
The Deseret News - "During a hearing in Colorado Springs, Colo., on Friday, a judge scheduled a May 19 jury trial for Rozita Swinton on a misdemeanor charge of making a false report. She is accused of calling authorities in February 2008, pretending to be a 13-year-old girl drugged, chained in a basement and being sexually abused.

According to court documents, the call triggered a door-to-door search until a mental health counselor told police it was Swinton, 34, who suffers from a multiple personality disorder. She has pleaded not guilty by reason of mental impairment."
First and most important fact to note is that this, is probably a predictor of what is going on in Arizona. Oh no, I would never imply special knowledge or back channel communication. Nooooo...not me. The fact that a trial date is set in May is an indicator that certain premiminary actions against Warren Jeffs will be finished with by April. Judge Conn has indicated he wants things done before trial, not after, so this month makes sense. There has been no activity on the filing front in Arizona, as I mentioned yesterday, for three weeks.

The Deseret News goes on to mention;
"Swinton's case has been delayed repeatedly since last year after she became a focus of the phone calls that led child welfare workers and law enforcement to the gates of the YFZ Ranch. She has been dubbed a 'person of interest' in the investigation. Child Protective Services caseworkers and law enforcement responded to a series of phone calls from someone claiming to be 'Sarah,' a pregnant, 16-year-old trapped in an abusive, polygamous marriage to an older man."
Now we're getting somewhere on the press front as they "notice" the foot dragging of her Criminal Lawyer, who mentions here that his firm's exclusive interest is criminal practice.



Swinton is a misdemeanant, not a felon. David Foley is pricey local talent for real trouble, and he's maneuvering like his client is on trial for something heinous, positioning her trial dates to take maximum advantage of other events.
"Swinton's criminal cases in Colorado were put on hold while she underwent inpatient mental health evaluation. A court docket from Castle Rock, Colo., obtained by the Deseret News last week said Swinton was placed at a psychiatric hospital in Missouri. The last entry on the court docket said doctors had indicated her discharge date was 'unknown'."
Well, I can tell you she was in Burley Idaho over the Thanksgiving day weekend, I can all tell you that there is a Federal psychiatric facility in Springfield Missouri, because that is where Elizabeth Smart's kidnapper Brian Mitchell was sent. Has Rozita been debriefed already by the Feds? Did the Deseret News ask that question?
"The El Paso County District Attorney's Office could not say if her status had changed, prompting the judge to set a trial date. Swinton's attorney, David Foley, did not return a call seeking comment on Friday."
It's a wild stretch I know, but did my little dust up about her blogging and traveling to Idaho have anything to do with it? Maybe. I'd love to think so but it probably was just vaguely coincidental.
