Let's go back in time:

US Attorney Brett Tolman

"Federal authorities have been probing allegations of crimes involving the Fundamentalist LDS Church and its leader Warren Jeffs for years — but have been unable to develop enough probable cause to launch a full-scale investigation or bring charges.
'Those cases where you hear rumor and innuendo about child brides and corruption, we have to have reasonable suspicion to open an investigation,' U.S. Attorney for Utah Brett Tolman said Thursday. 'Beyond that, we have to have probable cause to even get search warrants and grand jury subpoenas. That we have not been able to establish on numerous occasions.'

In an extensive interview with the Deseret News on Thursday (May 1st, 2008) Tolman and Tim Fuhrman, the special agent-in-charge of the Salt Lake City office of the FBI, detailed their efforts to investigate crimes within the FLDS Church. They also spoke against the need for a federal task force on polygamy-related crimes, despite a push by the U.S. Senate majority leader and the Utah and Arizona attorneys general."

That's four weeks after the raid. The FBI HAD NOTHING. They were still saying it.

Then enters the Shadowy Special Agent Johnathan Wilson Broadway? A man with Colorado Connections who neatly withholds information on Rozita's involvement from Texas Rangers, until after the raid is over.

FBI Special Agent J W Broadway, who leans on Anti FLDS forces that are not too bright, when they stray too close to sensitive material?

Brett Tolman also says:

"The crimes that are being alleged or that there is suspicion, these are predominantly state crimes. I think it's a rush to judgment to think that a federal task force is the answer."

So they have nothing at the FBI. They can't prosecute sex crimes unless they are Mann Act stuff.

"Right now, Tolman said that all his office has is suspicion and nothing more. Child abuse, rape and incest are all state-level crimes. So is bigamy.

'We have the ability to prosecute transferring or crossing state lines for purposes of sex, and we had a case a couple of years ago that we investigated,' Tolman said. 'When the young woman was interviewed, she indicated that no sex had ever occurred. At that point we're very limited outside some evidence to help us establish probable cause.' "

So we have a stymied FBI and no cry for help.

Let's go even farther back, to April 10th, the day before Special Agent Broadway "officially" hands Rozita's name to Brooks Long:

MSNBC/AP - "On Thursday (April 10th, 2008) state and local law enforcement authorities defended their decision to leave the sect alone for four years after it moved in.

'We are aware that this group is capable of' sexually abusing girls, Sheriff David Doran said. 'But there again, this is the United States. We are going to respect them. We're not going to violate their civil rights until we get an outcry.' "

So I guess we're waiting for a fake call to violate their rights. The FBI can't move, because outcries will be based on violations of local Law, and from the tone of this quote, Doran is feeling the pressure. It's been four years, they've got nothing.

The FBI wants at them, but complains there's that nasty constitution standing in the way. Locals want at the FLDS, but also, there's that troublesome document again.

When exactly did FBI Special Agent Broadway move to San Angelo, from Douglas County, where Rozita was convicted for faking being a little girl in distress?

Evidence dug up by the Pharisees VAST network of researchers say it was sometime after 2002. Agent Broadway appears to have been first stationed in Dallas, and then moved out to San Angelo. He seems to have lived there before, moving from Texas to Colorado and then back to Texas again, probably Dallas, and then out to San Angelo.

So he's been waiting four years too.  Are both men getting a little impatient?  I know the Doran article above makes him sound like he's wanted something to break for a while.

Did they just get tired of waiting and decide to prime the pump? Did Broadway "call someone" he knew in Colorado and "order up" a cry for help?

What we have here, is (a) failure to communicate (UPDATED)

Often, more often than not, if you're looking for someone or something intently, you can't see it because you're STANDING on it.

What we've got here is, failure to communicate:

From "The Truth Will Prevail" - "Although she had not phoned other agencies since March 29, Rozita went wild on the night of the raid and began placing numerous calls to crisis centers in B.C., Canada, and in Utah as well as to the National Child Abuse Hotline and the Arizona Child Abuse Hotline. There seems to have been little response to any of these calls with the exception of one placed to a safe house for girls in Mission, B.C. on April 3. The caller gave her name as 'Sarah Barlow,' claiming that she was the 'Sarah' who had sparked the YFZ raid and that she was being kept in an FLDS 'compound' in Bountiful, B.C. Jeanene Nelson, the woman who received the call, contacted the Seattle, Washington, FBI Field Office on April 9. Asked why she had not given the information to the Royal Canadian Mounted Police, she said that she had but they 'didn’t act like they were interested.' The Seattle Field Office phoned the San Antonio Division of the FBI to find anyone who might be interested in the information, which was finally communicated to Captain Caver and Ranger Long on April 11 by Special Agent John Broadway of the FBI San Angelo Resident Agency."

Your Modern Pharisee is a one armed Paper Hanger (or is that a one legged man in a butt kicking contest?) On occasion I get wonderful help from a couple of unnamed fellow travelers, but I can't count on it and it's often (far more often than not), uncoordinated.

Even my friends on the "inside" aren't always that helpful. I plead for information and usually don't get it. I dig in places that have already been mined out, I and others duplicate each others work. Agent Smith had said to me last year about his fellow agent, in Texas, calling him; "I'll recognize his name if I hear it." Then above little blurb gets published in "The Truth Will Prevail" a year later. I don't see Broadway's name, and we don't talk about it among ourselves.

I read the article, but as I do often, I'm skimming, looking for the familiar, and the bottom of the paragraph tidbit about Special Agent John W. Broadway? I missed it. That was four months ago. How long has Donald Richter known this? What we have here, is a "Failure to Communicate."

That little Strother Martinism could be said twice, (twice in Cool Hand Luke too), as that failure is at least foisted off on us by the FBI to possibly insulate Texas Rangers Brooks Long and Captain Caver from "knowing" about Rozita, until the raid was over. Supposedly Agent Broadway lets Long and Caver know on the 11th. The raid is officially put to bed on the 10th.

I've always said that if Long made any calls to CSPD on April 13th, he had to know something on the 11th (a Friday). These are Government employees people, and higher ranking ones. They don't work on weekends, unless they have to. If Long knew to call CSPD on Friday, then then FBI Special Agent John Broadway already had Rozita's name when he told him.

According to Donald Richter's article at "Truth," Jeanene Nelson called the Seattle field office of the FBI on the 9th. How convenient. Texas just finished removing all the children. The FBI moves in and does some poking around on the 10th, and THEN, and only then, we are to believe, John Broadway gives info to Long and Caver the next day, who sit on it until Sunday, and call. It would seem they are waiting to know who to call because first FBI Special Agent and Accountant John Broadway must find out who to call. Broadway-Smith-Mandel-Velasquez. Then you have to figure a note is passed back down the chain. Velasquez to Broadway, bare minimum. Long calls Mandel and/or Velasquez at CSPD. Voila! Long "finds out" about Rozita.

Only Special Agent Broadway probably knows already. How long did he know? Why does the Seattle Field Office call Special Agent John Broadway? From what I know, the man is an accountant, not a field agent. It is likely that Broadway knows this stuff when Seattle calls on the 9th. He's probably the clearing house for all things Rozita at this point.

All of this keeps pushing dates back, and now it pushes them back into the time frame where the raid was ongoing, and at least some of the children are still at the ranch. What does a sworn peace officer do in this case? Apparently sit on the info until the kids are safely stolen, bare minimum.

Again, I REPEAT, why does this clandestine back channel exist in the first place? We have cell phones and email and office phones and secretaries if we are in the FBI. WHY is there a POINT to POINT communication channel with RELAY RIDERS that hand carry notes out of sight of everyone?

WHEN was such a network set up? Building a pipeline takes time.

FBI Special Agent John Broadway seems to know Rozita's name on April 9th, 2008.

To use a pipeline to communicate (which MUST be built in advance) he must know that the pipeline goes to the right spot.

Unless some bizarre series of coincidences existed to have an "Old Boy" bathroom conversation network set up already (UPDATE: John Broadway has testified in a case with Denver connections), you have to build the channel because you already know you will need to use it. That means the channel is built no later than the 9th, and these things take time.

I don't know about you, but to me, unless these facts are just flat wrong, it's looking more and more like before ONE child was taken from the Ranch, the FBI already knew who Rozita Swinton was.

Another update, when researching Agent Broadway, it was discovered that he goes by "Johnathan W. Broadway" and "J W Broadway" as well as "Johnathan Broadway."

Plead the 5th? Not when you can plead "Ongoing Investigation."

I am often proclaimed a "Tin Foil Hat" wearer by various skulking anonymous commentators out there in the ether. For instance, what ever became of that WILD story I told over the last year an a half (approximately) regarding Some Unknown FBI Agent in San Angelo Texas calling FBI Agent Steve A. Smith in Colorado Springs? I mean really, Agent Smith? I just fell asleep watching "The Matrix" and thought I called that guy.

Except there was some unreported testimony in Walther's court on Friday or Saturday. In fact very little has been said in the media about FBI Special Agent John Broadway testifying at all. But he was there. He was there and someone asked John Broadway a question. The question was, "Did the FBI in Texas/San Angelo call the FBI in Colorado Springs on or before April 13th, 2008?"

What was Agent Broadway's answer? Reportedly his expression changed, and he said he couldn't talk about it because it was the "subject of an ongoing investigation."

That's not exactly "The 5th," I know, but it's what creative law enforcement does when they don't want to answer an uncomfortable question. It beats "The 5th," because if you do have an ongoing investigation that you're dragging your feet on, purposely, you can always shut up when asked uncomfortable questions that might evoke "The 5th."

Why was the question uncomfortable? Because the arrest warrant of Rozita Swinton, and the accompanying affidavit justifying that warrant would have us believe that Texas Ranger Brooks Long called CSPD Lt. (then Sgt.) Sean Mandel, and that was the contact that led to "Oh yeah, we know whose phone number that is, it's Rozita's!"

Never mind the fact I've harped on before that you don't "discover" who owns a phone number by calling the police department whose jurisdiction might overlap that cell phone exchange. You call the FBI who looks up the phone number, you don't call CSPD. On top of that, there's no reason to think that CSPD would KNOW anything about a phone number, not attached to a name.

As we learned in early 2009, that's not what happened anyway. It was an unknown FBI Agent in Texas that called FBI Agent Steve A. Smith, who then called CSPD Sex Crimes Unit Sgt. Sean Mandel, who was on detached duty with an FBI task force. Sean Mandel went through great pains to tell me, that he wasn't in CSPD offices during that time. See above, "detached duty."

At any rate, it was Sean Mandel carrying a note from Agent Steve A. Smith to CSPD, and Hugh Velasquez that got the message from the Texas FBI to the Colorado Springs FBI. Apparently the message was "Hey, Brooks Long wants to talk to someone about this phone number."

As observed before, that means that someone in the communication chain already knows whose number it is. The discovery is not being made by calling CSPD, the discovery has been made, and CSPD is being called. It's supposed to look like Brooks Long got on the phone on Sunday, April 13th, 2008, called Sean Mandel at CSPD and Sean told him the number he had, was Rozita Swinton's.

Only that is NOT what happened, and I am the only one who has reported that fact.

Now, FBI Special Agent John Broadway says he can't talk about it.

He can't talk about it? Wouldn't he have said "why are you reading crackpot blogs?" He didn't though. That's because what I told you is true.

Think about this all over again. I know I've asked you to before.

Why is there a communication channel between Texas and Colorado Springs regarding the raid?

Item one. Such channels take a while to set up. It was not set up on April 13th, 2008, to make a call on that day. It had to have taken several days to set up, more likely, a week, maybe more.

Item two. Why did it exist at all? You have to KNOW there is some role being played by Colorado Springs in the raid, to set up a back channel off the record, time consuming method of communication.

Item three. Such channels are meant to be secret, to set up for us an appearance in public that is being arranged behind the scene. Such a channel for orchestration of events and secrecy.

Conclusion. Law Enforcement knew of the existence and role of Rozita Swinton much earlier than they told us. They tried to keep it secret that they knew until after the raid was over. They might have even known about her before the raid, and if they did, it virtually shouts that they either contracted for the call to be made, or knew at the outset it was fake.

Jerry Strickland says David Foley is full of Smoke (and YES, Rozita will serve NO time)

We're not finished with the investigation, says the Texas Attorney General's office:

"Jerry Strickland, spokesman for the Texas Attorney General, told the Houston Chronicle today that the state's inquiry 'into Rozita Swinton and other aspects of this case is ongoing.'

Swinton, of Colorado Springs, was considered a 'person of interest' in connection with calls to a hot line alleging abuse at the Fundamentalist Church of Jesus Christ of Latter Day Saints' ranch in West Texas."

Oh, I believe David Foley, as he has not lied to me yet. How long does it take, JERRY? It's been almost TWO YEARS.

This interesting little tidbit is also included:

"Swinton was also sentenced to 45 days in jail but given credit for time served, so she faces no further jail time."

She didn't show for trial, Foley entered her plea (apparently) and she won't be showing up in jail.

The Salt Lake Tribune added this detail:

"The judge also limited her to one landline telephone and one cell phone and ordered her to give both numbers to the district attorney's office."

I wonder if she will continue to be able to use a computer, to access the internet? According to her "MySpace" pages, she was on yesterday.

Still unanswered? What happened to her deferred sentencing arrangement in Douglas County for her 2007 conviction of false reporting?

Dirty Deals Done Dirt Cheap - Rozita Swinton Pleads Guilty (UPDATE, will apparently serve no time)

The trial day shift was a technical matter, or a ruse, in any case, she has pled guilty. It also appears from the AP story on the subject, that everything is linked to Texas dropping any interest in charging Rozita:

Deputy District Attorney Frederick Stein, El Paso County Colorado - "Ms Swinton entered a guilty plea which was just completed 10 minutes ago. She plead guilty to a charge of false reporting to authorities and received a 2 year deferred sentence with several conditions."

This is also being reported by KRDO:

COLORADO SPRINGS - "35-year-old Rozita Swinton avoided trial by pleading guilty on a charge of false reporting (today).

Swinton made multiple fake calls to police in Colorado and Texas. She was accused of making a phone call to police in February of 2008, claiming she was a girl named Jennifer and was hurt and trapped in a basement. Police went door-to-door searching homes for hours, looking for the girl. The call turned out to be a hoax.

The judge deferred sentencing for 2 years, but he is still requiring her to serve 45 days in jail.

Police turned their focus to Swinton, when Texas Rangers traced a call to her, following the raid of a polygamist compound in April of 2009. In that case, a girl named Sarah told a social worker she was trying to escape the religious sect. Swinton has not been charged in that case."

I have contacted Douglas County to see how this affects her deferred sentencing agreement there. It may be that in delaying Rozita's trial as long as it has been delayed, that Douglas County no longer cares. I'm not sure how those sorts of things work, but hypothetically if her "deferred sentencing" in Douglas County stated "Don't Get Into Trouble" for 4 years, and those 4 years were up, she could then become convicted in El Paso County, and keep her Douglas County deferred sentencing agreement intact. The story errs in assigning the date of "April 2009" to the raid, which occurred in April of 2008.

It turns out that Rozita may not even go to jail, despite what it says above:

KKTV - The attorney for Rozita Swinton entered the plea on her behalf (this) morning to false reporting charges. In February 2008, Swinton started calling Colorado Springs police, telling them she was a 16-year-old girl trapped in a basement. The calls triggered a massive and frantic search in the northeast side of the city. Swinton allegedly also made calls to TESSA, a local group that helps domestic violence victims.

- Swinton was handed a 24-month deferred sentence. She received 45 days jail time but the judge gave her credit for time previously served in treatment.

Also it would seem that she did not even show up.

The Associated Press had this take on the story:

COLORADO SPRINGS, Colo. (AP) -- "(David Foley), attorney for (Rozita Swinton) says Texas authorities don't believe she had any 'criminal involvement' in telephone calls that triggered a raid on a Texas polygamist group.

Rozita Swinton of Colorado Springs was once considered a 'person of interest' in connection with calls to a hot line alleging abuse at the polygamist compound in Texas.

(According to her attorney), she won't face charges in that case. A spokesman for the Texas attorney general didn't immediately return a call.

In an unrelated case, Swinton pleaded guilty in Colorado Springs today to misdemeanor false reporting. The judge ordered her to get medical treatment but did not specify her condition."

It appears that we were just waiting for the Dirty Deal in Texas to be done.

What happens to the evidence that Texas took? Rozita's computer and cell phones?

I have been roundly ridiculed for connecting the cases, but it now seems that Texas has been talking to David Foley on Rozita's behalf. This is so dirty.

UPDATE: Judging from the case number, Rozita's case originated in 2008. The "M" after "2008" appears to does designate "Misdemeanor." On the whole page of 7 day call offs, there is only one case from 2008 that is a misdemeanor that is still in play in El Paso County. Rozita's. Don't tell me this is normal, this is highly unusual.

Could the "Cry for Help" have been deliberately contracted for by Law Enforcement? (YAWN)

I sent the following summary out to a number of News organizations in the Rocky Mountain West, late last week, none even attempted to investigate it. I'd be happily wrong if one of the turns up not to have turned a deaf ear, but it seems that unless I serve it up with signed confessions, they won't even try.

In 2005, Rozita Swinton was arrested for false reporting in Castle Rock. She subsequently plead guilty in exchange for a deferred sentence, providing she did not have further scrapes with the law. After that it has been documented that Rozita exported her false reporting to other states, apparently depending on the practice of not prosecuting such "pranks" when the prankster is not in a local jurisdiction. Most states, Texas included, do not seek extradition of misdemeanor offenders for prosecution. It is documented in the April 2008 arrest warrant of Rozita Swinton that Lt. Magdalena Santos (980D), took a call from the "Cocoon House" in Washington state in February of 2007 regarding a case of False Reporting in that jurisdiction, that was later traced back to Rozita.

One year after the incident in Washington State, Rozita was arrested for the second time we know of, after the Castle Rock arrest, in February of 2008, in Colorado Springs, again, for false reporting. Rozita has a long history of manufactured or unsubstantiated allegations, whether made in person or made by proxy, against others. Quoting from the Newsweek Article, linked to previously:

"Soon, Swinton came to the attention of authorities. Around 1997, she filed the first of some 15 police reports claiming that her father or some other man was sexually assaulting her (Clarence denies he ever visited Colorado). But 'we could never corroborate information because she would never do any follow-up,' says Det. Terry Thrumston of the Colorado Springs Police Department."

This documents, among other things, Rozita's presence in Colorado Springs when she was about 22 years of age. One could actively wonder why Rozita was being paid attention to by CSPD, as most law enforcement agencies would not pay attention to complaints regarding persons that did not even live in or visit the state of residence of the supposed victim.

This could be explained by the facts uncovered by myself, after following up on a tip. The tip was that Rozita and Lt. Maggie (Magdalena) Santos, and Maggie's coworker and "longtime companion" Lt. Janie (Jane) Anderson had an over 10 year relationship with Rozita Swinton, dating back to at least one of them employing Rozita as a "nanny" in 1997. Lt. Santos and Lt. Anderson's relationship is corroborated by mutual home ownership in the Colorado Springs area.

When contacted, Lt. Santos declared that the relationship was "20 years old" and that she had employed Rozita for "a month or two" as a "nanny." I then confronted her with the statement of my source, that there was a deposition, purported to be given by Becky Hoerth that dated the relationship to the year 1997 and that Rozita was both 14, 20 years ago, and living in Tennessee. Maggie then quickly reset the date but insisted that it was not 1997, instead claiming the date of 1995. This claim is of dubious reliability since Maggie had been wrong in her initial claim and then claimed not to have known Rozita well, known that she was from Tennessee or known her since the time she did employ her "briefly." I refer again to the facts cited by Newsweek, that Rozita was a frequent complainer about her ex convict and murderer father Clarence, who did live in Tennessee.

"(O)n page 1/50 of the discovery under Becky Hoerth Statement says:


'Ms. Hoerth stated she met Rozita in 1997 through a mutual friend at the Colorado Springs YMCA. She stated at the time Rozita was doing day care for Maggie Santos and Janie Anderson. She stated the two of them have been friends and that Rozita has helped her out when ever she needs it. She stated she had just recently moved back from Wisconsin and due to financial reasons is staying with Rozita'


This cannot be disputed as it is in the discovery."

In that Terry Thrumston of CSPD states the Rozita complaints regarding her father began around 1997, and the above alleged statement also refers to 1997, it would seem at least that Maggie's statement again, was at least inaccurate.

When confronted with information that the relationship was more extensive, and ongoing, and that she had been involved in subsequent dealings involving Rozita Swinton, Maggie claimed to have "recused" herself voluntarily from those proceedings, based on their previous passing acquaintance.

Again, returning to my source, who I checked with again:

"One of the problems is its affecting the case aganist [sic] Rozita(for Rozita's benefit) since Maggie didn't recuse herself 3yrs ago. The only reason she pulled out was because Becky outed her and Janie in her statement so she was forced to pull out." (email via PDA)

This probably refers to the Douglas County case (Castle Rock) or some unknown incident in between the report from "Cocoon House" in Washington state and the Castle Rock case.

If someone is conducting an Internet sting for sex crimes against children. Do they not need a little girl imitator?

Rocky Mountain Women in Law Enforcement - "Sgt. Maggie Santos has been with the Colorado Springs Police Department for 15 years. Before joining the CSPD, Maggie was a teacher for a few years and decided that policing was where she really wanted to be. She joined the department in 1992 and spent time working midnights on patrol, joined the Neighborhood Policing Unit, and spent time as a School Resource Officer. Maggie has also served the department with her bilingual skills as she is fluent in Spanish. Maggie was promoted to the rank of Sergeant in 2000 and after a couple of years as a patrol supervisor, moved to the Major Crimes Section, in charge of the Sex Crimes, Crimes Against Children Unit. As part of her current position there, she supervises an Internet Crimes Against Children team which has been responsible for several high profile internet based sex offender arrests.

Maggie is currently working toward promoting to Lieutenant. Maggie was also one of the original members of the RMWLE Conference team, serving since our project begin back in 2002. Maggie serves as a Board Member and during our conferences is known as the 'AV Guru' knowing how to save the rest of us from our electronic stupidity. We are thankful!

When she is not toting her gun or fixing a digital projector, Maggie has two kids to keep her busy and spends time quilting, reading and mastering video games. Thanks Maggie!"

We've seen these stings on TV. They usually have someone pretending to be....

Colorado Springs Gazette - "Police in Mesa and Jefferson counties who posed as underage girls in Internet chat rooms say Sgt. Gregory A. Sallee attempted to arrange sexual encounters." Sept, 2007.

Nov, 2007:

The Gazette - "Cañon City (in neighboring Fremont County) police have arrested a California man in an Internet sex predator sting — the department’s 13th such arrest this year.


Police arrested Carl Michael Pfaff, 50, of Oxnard, Calif., on Friday after he traveled to Cañon City intending to have sex with an underage female. He was actually communicating online with an undercover police officer, police said."

Also in November 2007:

The Gazette - "Fremont County authorities have arrested a 52-year-old Denver man who they believe drove to Cañon City to have sex with a young girl.

Jeffrey A. Tensly was arrested Tuesday at a Cañon City convenience store on suspicion of criminal solicitation, sexual assault on a child and unlawful sexual contact, Cañon City Police Department Capt. Allen Cooper said."

August, 2005:

The Gazette - "Sgt. 1st Class Andre Ventura McDaniel, 40, shot himself in September 2004 after he was arrested in an Internet sting after allegedly trying to arrange sex with a teenage girl."

And from April of 2007:

The Gazette - "It was just one chapter Friday in what was one of the most hectic days for the department in recent memory.

On top of a carjacking that ended with two arrests after a 90-mph chase that included shots fired at sheriff’s deputies, police dealt with drug busts, robberies and a 34-year old man arrested on suspicion of using the Internet to try to arrange a sexual encounter with a 13-year-old."

Sept, 2007:

The Rocky Mountain News - "A correctional officer at the Arkansas Valley Correctional Facility in Ordway has been arrested on suspicion of attempted sexual exploitation of a child.

Richard Jefferson Harris, 52, of Pueblo, is accused of contacting someone in an Internet chat room whom he believed to be under 15 — actually, an undercover district attorney's investigator — and allegedly solicited sexually explicit photographs.

He also attempted to arrange a meeting, said Pam Russell of the Jefferson County district attorney's office."

January 2008:

NBC "News First" 5 - "New developments regarding a News First Investigation we showed you over the Summer of 2007. It deals with some of the most disturbing criminal behavior our local officers have to deal with -- sex crimes against children.

Despite all the high profile crackdowns on internet predators, men continue traveling to the Front Range to try to have sex with young kids.

News First was granted exclusive access to what's arguably one of the most prolific Internet Crimes Against Children units in our state, at the Cañon City Police Department. It's one of Colorado's smallest police departments, and the officer who cruises the internet looking for predators only works that part of the job part-time. However, they still manage to capture, or assist other agencies in capturing, at least 1 suspected sex offender a month. Two of the units high profile captures that happened in Cañon City and include a Texas Constable and a Quiznos executive."

Such interstate and region wide sex sting operations almost certainly involved the FBI at times. The stings did involve local police departments and also the Colorado Bureau of Investigation.

I also called Lt. Kirk Wilson of the Internal Affairs division of the CSPD. Lt. Wilson took down all I had to tell him and promised to begin an investigation. He asked for my name, and date of birth, and said he'd send me a "receipt" for the report, which would contain a receipt number. That was late last week, I have not received it yet.

Lt. Wilson also declared in response to my claim of familiarity between Rozita and Maggie that indeed he knew of the relationship, and said it was "common knowledge" in the department. I returned later to this phrasing and challenged him a bit on it, and he qualified it a little bit and said that did not mean everyone knew of the relationship. Clearly the "relationship," whatever it might entail was widely known. None of this however was reported in the press, but it does lend credibility to the rather incredible suggestion at the time, that members of the Texas Rangers called CSPD and there was an immediate acknowledgement that the numbers the Rangers sought information about, were involved in previous cases. After all, the relationship of Maggie and Rozita is characterized as "common knowledge" by the head of CSPD's Internal Affairs.

This makes even more interesting another fact I discovered in January of this year. The April 2008 warrant says that the Rangers contacted Lt. (then Sgt.) Sean Mandel of CSPD first. This is not true, according to Sean Mandel. Per Sean, he was more or less a carrier pigeon for messages from Texas that were being received by Agent Steve Smith of the Colorado Springs office of the FBI. He distinctly recalled the incident and was quick to provide the information that he could NOT have received the call as he was on "detached duty" with the FBI, as part of a "task force." He stated clearly that he was NOT going into CSPD offices at the time. I did not think to ask what that "task force" was doing. Could it be Internet sting operations for predators? It would make sense, as Lt. Mandel is with the Sex Crimes Unit of CSPD.

Lt. Mandel readily provided me with Agent Steve Smith's number, I called him, and he answered a few questions briefly, and then called me back. He confirmed that he was taking information from the FBI in Texas, but "couldn't recall" which agent he was speaking to but "would know it again if he heard it." I asked him if he received the information by phone, or email, and he said he "didn't recall." I asked him if he could review the case and he said that he did not open one and thus could not access his records and determine by what method the request had come, or who had made it. Further questioning had Agent Smith stating that if such a request had come it, there would have had to have been a case opened on one side of the call or the other. I researched over the next day or two the officers that worked in the San Angelo office of the FBI, provided those names to Agent Smith, and asked if any were the agents that contacted him and he said none were.

Eventually my inquiries took me to the regional office of the FBI in Dallas, and Mark D. White, after initially speaking to me on the subject, dodged my questions for several weeks and eventually plead an "ongoing investigation" prevented him from even telling me IF there was a case properly opened on the Texas side of the Agent Smith conversation. What I have discovered here it would seem is a back channel of communications that would appear to be designed not to be "on the record." The warrants say the conversations were with CSPD directly, with Sean Mandel directly and began on April 13th, 2008, a Sunday, after the raid was over.

In view of the length of time it normally takes to set up such a carrier pigeon sort of relay, it is highly unlikely that this channel came into existence over that weekend. It seems designed to have stayed off the record and may well have been in use during the raid and perhaps before it. That goes directly to "what did they know and when did they know it?"

Some of the questions that arise from this research are:

• * Was Rozita a "little girl voice" used as talent by any law enforcement agency?
• * Why were (allegedly) Maggie and Janie shielding Rozita from prosecution?
• * If there is a statement/deposition of Becky Hoerth, as alleged, was Texas aware of it?
• * Is Rozita's attorney essentially blackmailing (legally) CSPD, the FBI and Texas with the knowledge that THEY KNOW of the character and extent of CSPD's relationship with Rozita Swinton?

Rozita has been provided with extensive medical treatment out of state, and has apparently not worked in the last year and a half. She has been seen and photographed in Burley Idaho, during the Thanksgiving holiday of 2008 and I have the pictures. She has some of the most expensive and connected legal talent in criminal defense in El Paso county. Her trial has been delayed more often and more successfully than that of Bernie Madoff and for more time. Within a week of her arrest, David Foley, her attorney, was trumpeting that there would be "surprises" in her case, and since then has gotten all these delays, which keep putting her case after FLDS cases in Texas on the calender, and he has said nothing about those "surprises" he asked us to "stay tuned" to hear.

If it is true, that Texas knew of the statement of Becky Hoerth, then it becomes a question of what might be called exculpatory evidence withheld from the defense.

Additionally, the relationship of Hoerth, Anderson, Santos and Swinton seems vastly deeper than has been admitted to by Lt. Santos. It is at least improper not to reveal these facts to the defense in the largest child custody episode of US History.

The call may have been contracted for by an law enforcement agency so as to gain access to the YFZ ranch. This would be criminal.

Rozita may have been criminally shielded from prosecution by her CSPD friends and as a result, was allowed to negligently wreak havoc later.

Any or all or any combination of these scenarios could lead to exclusion of evidence collected at YFZ. With that evidence excluded, most of the 12 YFZ defendants would likely go free.

A fundamental reason Rozita's trial is being delayed.

There is supposed to be, this deposition.

A deposition that NO ONE on the defense side of the FLDS equation, knew about.

Well, they do now.

Thanks to a poster on the other side (everyone's good for something you know), It dawned on me. I've been saying that Rozita's relationship with Maggie Santos and her "partner," wasn't on the record.

Well, actually it was, in this "deposition."

As soon as the trial starts, don't those things come out? In the process of defending his client, David Foley would point out the relationship of Maggie Santos and Rozita Swinton (and Maggie's partner) and who knows who else.

So the trial is delayed, and delayed, and delayed, and delayed.

I'd say that's pretty plausible, because once the trial starts, it's now on the record, for everyone. That's why the FLDS trials in Texas have to start, before Rozita is tried. Sounds plausible. Doesn't it?

If the plausible is the actual, there are a lot more people involved in covering this up because you don't delay trials for the reasons given about, without someone's participation and/or appreciation and/or request and/or a quid pro quo.

Sorry Rozita, if I'm right, I just took away a trump card. I hope you have others. Like maybe someone asked you to call.

If all of the above is TRUE. Texas probably knows about the deposition, and has withheld that knowledge, from the defense.

More on the relationship of Lt. Maggie Santos and Rozita Swinton

When someone doesn't tell you the truth, or at least, when they skirt around it, and you check their story, you keeping sitting up straight in your chair and having those insight moments. Here's another insight:

From the April 2008 arrest warrant of Rozita Swinton.

"On February 14, 2007, Sergeant Magdalena Santos (980D) was contacted by Jenna Hamilton from the Cocoon House located in the state of Washington. Ms. Hamilton stated she was concerned for the welfare of a 14-year-old she was talking to identified as 'April' from Colorado Springs, Colorado, who had been calling her since September 2006. Ms. Hamilton advised 'April' would call several times a week reporting sexual abuse by her father and uncle. She advised 'April' had told her she was staying at the TESSA safe house with her mother (at) the end of 2006. Ms. Hamilton stated 'April' told her she was a student at Rampart High School. Ms. Hamilton stated she had spoken with counselor Catherine DiNuzzo at the school in reference to 'April.' Ms. Hamilton advised 'April' had called from 719-447-7981 and 719-217-7329."

Since we now know it was "common knowledge" around CSPD that Lt. Maggie Santos knew Rozita Swinton, we can assume that Maggie was familiar with her cases. At least, she was familiar with the February 2007 call from Jenna Hamilton. She TOOK the 2007 call from Jenna Hamiliton. She KNOWS Rozita has "exported" her talents after her Douglas county guilty plea on similar charges where Rozita received a deferred sentence.

So, are we to believe that in view of Maggie's familiarity with this particular case of a young teen girl complaining of sexual abuse to a shelter in Washington State, from old friend Rozita, that Maggie turns on the tube, Fox, CNN, ABC, CBS, NBC and during the first part of April 2008, watches the unfolding drama (along with her friend "Beta") and doesn't say "Oh CRAP...ROZITA?" Don't they have an IMMEDIATE responsibility to call and say "WHAT NUMBER IS YOUR CALLER CALLING FROM?" The story was so plastered all over the news that it was like it was happening in their back yard. And really, it was, because in February, the month before Rozita began calling Texas:

Newsweek - "This past February (2008), according to an arrest-warrant affidavit against Swinton, Colorado Springs police responded to two 911 calls from someone claiming to be Jennifer, a 4-year-old abused girl locked in a basement. By tracking the calls, cops narrowed the location to a two-block radius and then searched the area house by house for a trapped little girl. Swinton 'basically shut down a whole police division,' says Thrumston. The girl was never found. (In between calls, Swinton also found time to get elected as a state delegate for (then Sen.) Barack Obama in the Colorado Democratic caucuses.)"

Toes also says that if IA doesn't look at Rozita's and Maggies (and Beta's) phone numbers, they're not trying.

Don't tell me they didn't think of it. They are detectives. What do they do? They DETECT.

Latest Rozita Revelation started with this: Was she a NARC?

The latest Round of Rozita Revelations started with my friend "Toes," after one of our brain storming sessions. I updated a speculative post that was primarily written to tweak press interest which is typically pointed in other directions:

March 30, 2009 - "The owner of the MySpace page has made a convincing presentation that she is not a close friend of Rozita, but a passing acquaintance. For that reason I am at least for now, removing references to her home page and her name. What is odd is that this paints a portrait of a young woman trapped in the idea that she is still in High School, and hanging out with High School students in Colorado Springs, pretending to be one of them.

It has been suggested to me by a friend that this is what a 'NARC' does. It's a totally wild speculation, but could it be that Rozita was such a person, employed by law enforcement to befriend High School students, as if she was one herself?

Right now, I caution, that's just wild speculation, under the heading of "What if?' "

Trying to follow Rozita has always been very difficult. Her associations, aside from that claimed by former foster mother & GLBT rights advocate Mary Catharine Nelson, and a probable foster parent in Idaho have always been glancing at best. Rozita often claims strong ties by implications or actions with persons whose memory of her is fleeting. Either that or their memory of her is strong and they view her now as radioactive and lie about it.

The above quote is an edit from the original speculative post which was based on the fact that one of Rozita's two known "My Space" accounts was claiming to be moving, and the other was claiming to live in Ontario. As a now "put off" trial date approached, it seemed as if Rozita was saying she was leaving the country. The flurry of associations around Rozita led to a woman now no longer in Colorado Springs (or the west for that matter) that seemed to know Rozita well, based on what Rozita was saying about her. According to that woman, who I still believe, or at least want to believe, she barely remembers Rozita.

I believe her because of what she insisted was true about Rozita. That she was part of another group of High School students that hung out at the same bowling allies. She saw her, heard her name, and knew of her, but associated her with that "other High School" group. Why does one woman remember another woman she doesn't know in another group of High School students? The most credible reason is that the woman I mention that gave me this information is a lesbian. Rozita would seem to be one herself, and hung out with a group of lesbians in that time frame, in Colorado. Perhaps this unnamed person found Rozita attractive, at any rate, she remembered Rozita, but didn't really know her and claimed she was on the periphery of her activities.

This is what my tipster saw. The tipster has inside information that I have verified first hand. The tipster began to search the internet for terms like "Rozita" and "NARC" and found me. The tipster was concerned and increasingly agitated about the free pass Rozita was getting and claimed to know why.

Why?

Because "Tipper" alleged that Rozita was employed by Lt. Magdalena (Maggie) Santos of CSPD and her lesbian life partner who also works closely with Maggie at CSPD. Lesbians. Again.

I verified that the two individuals DO in fact work for CSPD. They are often mentioned together in CSPD and association literature. They own or recently owned a home together in in the Colorado Springs area and the other woman whom I've called "Beta" has been "outed" as a lesbian, by name. It makes sense to assume that she and Maggie are a "couple."

So on Saturday, I got an email from "Tipper."

"The interesting part about this is that during the interview of Becky Hoerth at Colorado Springs Police Department she stated she meet Rozita through friends Maggie Santos and **** ****(Beta) these two individuals are both Sargent's with CSPD who happens to be a Lesbian couple.. Rozita use to be there nanny! Very Interesting, right? For someone who claims to be LDS is surrounded by lesbians does not make sense. I was also told that Maggie Santos has a hand in the investigation with Terry Thurmston who is also a female. Does this not seem odd? Why would you not remove yourself from a case when you have a relationship with the individual involved? It's all shady to me but what do I know."

A subsequent interview with Maggie, which led off with me asking for "Rozita" after calling Maggie on her cell phone had Maggie immediately claiming that the relationship was 20 years old (Rozita was 14 and in Nashville TN). I discounted that as unlikely (frankly nearly impossible) and Maggie retrenched at 1995 being the date, after being confronted with the date of 1997. Maggie's recollections were alternately wrong, vague or specific based on what served her best. For that reason I do not believe Maggie. She has changed her story and Tipper has not. Maggie would not clarify and promised to swear out a criminal complaint if I contacted her again. All of this started in very friendly fashion but in less than 12 hours descended into threats and claims that I was "blackmailing" her. I would not publish her name until after she refused to clarify and after she cut off communication and after her story was called into question. I had kept her name out of the story because it would be wrong to name her if she just had a passing relationship with Rozita once. It now seems it was not a passing relationship. Back to Tipper, paraphrased and redacted ever so slightly so as to hide Tipper's identity:

"Page 1/50 of the discovery under Becky Hoerth Statement says:

'Ms. Hoerth stated she met Rozita in 1997 through a mutual friend at the Colorado Springs YMCA. She stated at the time Rozita was doing day care for Maggie Santos and **** ****(Beta). She stated the two of them have been friends and that Rozita has helped her out when ever she needs it. She stated she had just recently moved back from Wisconsin and due to financial reasons is staying with Rozita."

This cannot be disputed as it is in the discovery."

I stress that this document simply exists, or does not. "Beta" and Maggie are close enough to the situation to verify this, but Maggie will not. CSPD or El Paso/Douglas County officials can verify it too. I'm either wrong, or right about the existence of this statement, which is worded almost exactly as I have presented it above. There is even a page reference. Back to Tipper:

"Some of (Maggie's) statements to you are incorrect also; such as (Rozita) worked for her longer. (It was hoped that) if either one of them spoke with you that they would be honest this. My concern (is that Maggie) is hiding something. One of the problems is it's affecting the case against Rozita (for Rozita's benefit) since Maggie didn't recuse herself 3yrs ago. The only reason she pulled out was because Becky outed her and Beta in her statement so she was forced to pull out."

Again, this is ever so slightly redacted and paraphrased for the purposes of concealing Tipper's identity.

Since nothing Tipper has said to me has been contradicted by the facts and Maggie has already owned up to getting one critical detail wrong, I'm going with Tipper for now. Tipper has not had to retract one bit of the story so far. Much of it has been independently verified.

So when did Rozita start getting into trouble with the law on phony tips?

"ABC News - Colorado Springs police said Rozita Swinton had made calls in February (2008) in which she pretended to be a girl locked in a basement, claiming abuse and calling authorities for help. Swinton has a record for making similar calls in 2005."

2005? That fits with "3 years ago" when it is said that Maggie was forced out of the case, forced to recuse, as opposed to doing so voluntarily. If this is the case it would call entirely into question everything that Maggie said, such as details like not knowing what part of the south Rozita came from (Tennessee) or unverifiable (at this time) details like exactly when and how long Rozita worked for Maggie, or that Maggie and Beta both employed Rozita together.

So how do we speculate at this point?

Was Rozita at one time, "locked in" Maggie's basement? This is a fair question to ask. Unlikely, but nonetheless fair. As I have said to Maggie and many others, lies tend to contain elements of the truth. I would guess from what Rozita said, she'd been locked up somewhere once, by somebody and it really bothered her. Not exactly a surprise.

Was Ms. Swinton's relationship with either Beta or Maggie ever sexual? If a male police officer had a long ongoing relationship with a female suspect in and out of trouble with the law that required rescuing, it had better be a relative, or the department will eventually ask "are you doing her?"

Was Ms. Swinton a snitch? A confidential informant? A "Narc?" Stories from one of my other sources (now unnamed) says she may well have been. At the time she was in Colorado, she was in her 20's and apparently was viewed as another High School student and "hung out" with them.

Was Ms. Swinton a convenient warrant factory? Can't get into some residence? Need help? Maggie has a nanny that can fake an abused kid's voice and you're in the door, no problem! Rozita at 33 convincingly passed herself off as 15. To several people.

These last two speculations gains more weight when viewed with how quickly CSPD was said initially, to have ID'd her. Texas calls. There was a lot of back channel chatter off the record as well. We were asked to believe that they said "Oh yeah, those are Rozita's numbers." If most lies do indeed contain an element of truth, what if CSPD really knew who Rozita was by the phone numbers she used? Texas calls. "No problem, we know that gal."

Some other questions that need answering are among others, is there some sort of accessible database on which Rozita and her number were already published. We know that since 9/11 there has been an effort to coordinate and consolidate information between various law enforcement agencies. Would it be possible for the FBI in Texas for instance to type in Rozita's number and it comes back with "PAID SNITCH, ROZITA SWINTON - CSPD?"

Would you type in the number and it says "NUMBER IN CASE IN COLORADO SPRINGS, PERP ROZITA SWINTON?" This was the goal post 9/11. Is that possible in this case and if so, was it done?

More "out there" but deserving of consideration as well is the idea that someone was calling around looking for a decent actress to play a part. Does this lead to Maggie and "Beta's" warrant machine Rozita? Does someone need to be checking into cases investigated by Maggie and her department for the veracity of the information or informants used in gaining warrants in Colorado Springs?

I've fed all this information to the press and their reaction? Meh. As a matter of fact, I mentioned on Brooke Adams blog at the SLTrib that there was a relationship between Maggie and Rozita. Her reaction? She didn't publish it. I didn't link, as I recall. I did not characterize the relationship with anything other than that which Maggie has willingly confirmed to me personally. Brooke comes on today, makes a comment herself, but won't publish that cold hard simple fact.

Why?

PS: As of this post I am making it official. If you post at this blog, you're going to have to make sense. Ranting this and ranting that and blindly ignoring evidence will only get you published here if it is a great example of how idiotic you are. Other than that, you're going to get rejected. Jam's last post is not published, but not because it was stupid. It was not published for reasons Jam knows.

UPDATED (again): Rozita. Source says: Lt Maggie Santos untruthful.

Since nothing essentially, that my source has told me, has been refuted, I will publish the source's response to Lt. Maggie Santos.

"Some of 'Alpha's' statements to you are incorrect. Rozita worked for her longer. I am concerned Alpha and Beta are hiding something. The problems is it is affecting the case against Rozita in ROZITA's FAVOR. Alpha DID NOT RECUSE 3 yrs ago. Alpha pulled out was because Becky Hoerth outed Alpha and Beta so they were forced to pull out." (this is a paraphrase)

This is getting VERY interesting.

Alpha is CSPD Lieutenant Maggie Santos.

Maggie's rebuttal to this information is the following:

"I have nothing to add, feel free to pull CSPD reports. If your source has a complaint they are welcome to file a complaint with IA (internal affairs)."

And:

"If your source has more information ask her."

Please note that I have not identified the gender of my source, nor will I be tricked into doing so now. I have disclosed nothing to Maggie about the identity of my source:

"Smells like blackmail."

Lt. Santos has had every opportunity to clarify and refuses to do so. I cannot evaluate the truthfulness, ultimately, of either party, but more of what my source has said, checks out, as opposed to that which Maggie has said. I note that Maggie was truthful that Rozita was her Nanny, but her explanation of time frames stretches credulity to the breaking point.

An invitation to file a complaint with internal affairs is an invitation to go public. I would greatly prefer to have Maggie's greater insight into this matter, but she does not give it.

The Modern Pharisee does not take the position that Maggie is untruthful. The Modern Pharisee does not take the position that the source I employ is truthful. I present both sides and point out that so far, more of what the source has said, checks out.

Maggie also says she will change her cell phone number tomorrow, which means that she no longer wishes to comment. Her last communication to me by email:

"I am requesting you not contact me again, by phone, email or in any other format. As I explained to you on the text, at this point any information you want should be done through CSPD. I have notified my chain of command that you are becoming creepy and I am concerned about the safety of my children (whom you are now bringing up). You have access to my personal cell, email and may have access to my address. Any further communication I will consider harassment and I will also consider filing this criminally."

This is what is known as a "non-denial denial."

I got Maggie's phone through a publication where she published that phone number. I got her email the same way. I have published neither. I believe that I have her address but I am not interested in revealing it. I will not do so. She has requested that I no longer communicate with her, and I will not. I asked her to clear up the time frames, and she would not. None of my communications will show that I have even hinted at revealing anything but her name. I will also point out that I have NOT identified "Beta."

Arrest Brooks Long

This is step one. He lied in an affidavit and/or under oath to the court.

The Salt Lake Tribune - "(A private) investigator for (FLDS Attorney Gerry) Goldstein testified that he checked with the Schleicher County Medical Center and learned no one from law enforcement had ever attempted to verify the caller's claim of being treated there for broken ribs. That contradicts testimony by (Texas Ranger Brooks) Long, who said that was done by the district attorney's office."

Brooks of course may legitimately implicate someone else, such as a person who REALLY and TRULY told him from the DA's office that they did in fact call. There could be other mitigating circumstances such as the discovery of actual notes revealing such a call was made. I grant that if the officer was telling the truth and if the DA did in fact call, that they're hardly expecting the defense to successfully discover evidence that they did not call.

As it stands now, the most likely explanation of the testimony by the FLDS hired private investigator is that no one called. This raises the point of active conspiracy, real and actual. This says that Texas Ranger Lieutenant Brooks Long perjured himself and that he and several others did so in support of the warrant used to enter YFZ. A warrant that you lie to obtain is a prima facie case for there being no probable cause.

Warren Jeffs to finally get his evidence hearing?

The state of Arizona had until end of month, last month, to reply to Michael Piccarreta's request for a hearing. Apparently, the didn't. They just let the time run out.

The Kingman Daily Miner - "According to (Michael Piccarreta's) motion, efforts to resolve the issues have been unsuccessful.

Both parties had until Friday to submit their decision on whether to hold an evidentiary hearing on the matter. Otherwise, the court will set a date and time for a hearing."

There was no such cooperative agreement, so now it appears that Judge Conn, who is bent on getting this done this month, will set a hearing date. This month. We'll wait and see.

Revisiting when Texas knew.

Something critical happened, that if known, would expose a fact Texas does not want known. It happened at 10:40am, CDT, April 9th, 2008. It's in regard to Rozita Swinton, and the raid was still going on.

In addition, the area code, and phone number of the phone calls was known to Texas from day one, and they knew it was coming from a Colorado Springs phone number. That may seem obvious, but Texas has tried to hide how early and how specific their knowledge was. Texas just flat knew and they knew early on. Bare minimum, they knew while they were still raiding and carting off evidence. So did the FBI. Not so odd then, that Mark D. White of the Dallas office of the FBI says he CAN'T talk to me. After all, there is a Federal Grand Jury now. They figured that they'd have so much obvious evidence by the time they were inside, that they didn't care the call was bogus, they were just glad they had it. It gave them an excuse. Piccarreta's Latest Motion, moves to strike. (UPDATED)

The motion is 63 pages long. It contains the interviews of Brooks Long and David Doran. I'll update and comment as I become familiar with it.

Point one, Piccarreta says Texas wrote Arizona's motion. That's hilarious. It's also probably true.

Point two, there are several excellent points made but I'll focus on this. Texas may well conspire and cooperate among the FBI, Rangers, Sheriffs and Judges, but Judge Conn in Arizona would not be part of this cabal, in fact the obstruction of Texas which has worked for them to this point on their side of the border, works against them in Arizona, and if they are NOT forthcoming, will get the evidence excluded. Piccarreta notes that it is the court's duty to do this when such obstruction is carried out.

Texas KNEW all along. The FBI continues to Stonewall on Swinton investigation.

Mark D. White of the Dallas office of the FBI continues to have my calls verbally screened. Today though, the message changed.

Instead of saying that he doesn't have the time, or that he has nothing for me, he's now changed to saying he can't talk to me.

That'll do I guess. I am forced to interpret this as YES, The FBI DID open a case on the Texas side of the inquiry into Rozita Swinton. I am also forced to interpret this as being they are sensitive on the date.

What this means, until I am supplied information to disabuse me of this notion is, that if revealed, the date of inquiry into Rozita's phone numbers would substantially alter the public perception of the case. It's TOXIC in other words.

Mark of course could ask me to print a retraction of this, but in doing so, he would have to tell us when it was that the FBI requested the information. He knows my number. From now on out, I will cite this conversation with the Dallas office of the FBI as proof that Texas or the Texas FBI knew about Rozita Swinton, prior to executing their search warrants.

I will be HAPPY to issue an immediate retraction, but to do so, I would have to have the acknowledgment that a case was opened, when it was opened, and who requested it.

What's that all about? UPDATED

Rozita had a GUN and they let her KEEP IT? What's this all about? I don't know what to think, either we have another one of Bluesy's weird, always anonymous friends or this is a tale from the inside.

"TxBluesMan, Is the only one who gets what happen. He so has it there is no conspiracy. I will tell you that the LE in Colorado did not do things the way it should have been done. I have inside information. The arrest warrant was thrown together at the last minute so there goes a conspiracy theory. The bond was asked to be increased due to safety risk to the public and flight risk. If this was the case why didn't we confiscate her gun. CSPD isn't that smart to be involved in a conspiracy. We arrested her on a case that we had no proof that she was involved in in order to get her in so that the Rangers could question her. Along with the search warrant we were suppose to use it to gather evidence for the 'Feb call' but no it was a back door to let the Rangers in to get what they needed. So about 90% of what was taken from her apt the Rangers took back to Texas with them. Now we run into the problem of the case we charged her on. It's all circumstantial we have no proof she is connected to the 911 call. This is why the case has been delayed. If you notice the arrest warrant list a lot of circumstantial evidence, situations she has never been charged on. If you saw the discovery you would flip more than you have been. It is all circumstantial we have no proof. The reality is only one of the numbers are connected to Swinton. Is the (719)243 number. The other is connected to other Colorado calls that we have never been able to connect to her. Not only did we scew that up. Swinton asked for an atty before she even knew what she was charged with. After she asked for and atty and read her rights we continue to question her and we allowed the Rangers to enter the room after she asked for an atty. We realy screwed this one up. Finally ,I got that off my chest."

Frankly, it SOUNDS a little like one of the weird Rozita sympathizers that float around out there, but I don't have anything to say other than to offer it up for you to look at.

UPDATE - SPECULATION: This person is not literate enough to be CSPD. I too have my doubts about the relative wisdom of some of our boys in blue, but this is not well written.

BUT, on the face of it the writer would seem to have been there. So if the writer is not an outright liar:

Yes Martha, Texas KNEW about Rozita before the raid was over.

The only questions of course being, how much did they know, and when did they know it. This starts to look like a full on cover up/conspiracy more and more each day.

I made these humorous points to another blogger who is a doubter and another blog. I liked them so much, I made them into a post here.

I will give you some of the various governing laws and principles that affect the flow of communications within a bureaucracy. All of these are squared as to effect when between two agencies, cubed when between three. There are three agencies involved here, that I know of, hence it took more than two days, or even three to get from the discovery of Rozita to the discovery of the Peace Officer with knowledge of her crimes. It in fact represents communications that are relative to light speed for Brooks Long to contact CSPD before the middle of the month. I personally was astounded. We must however assume that normally, the complexity of this path of communication means that the Texas Rangers, or the FBI knew about Rozita before any of them (the Rangers, the FBI and Rozita) even existed.

Law of Communications:

"The inevitable result of improved and enlarged communications between different levels in a hierarchy is a vastly increased area of misunderstanding." (What he said)

The Army Axiom:

"Any order that can be misunderstood has been misunderstood." (It was a miracle!)

Spark's 10th Rule for Project Managers:

"Give all orders verbally. Never write anything down that might go into a 'Pearl Harbor File.' " (they obeyed this law, I'm impressed)

Cornuelle's Law:

"Authority tends to assign jobs to those least able to do them." (They asked the wrong guy)

Parkinson's Third Law:

"Expansion means complexity; and complexity decay." (There were at least 9 people in the chain of communications. The message should have been destroyed once, lost once and repeated a total of three times before reaching the end.)

Parkinson's Fifth Law:

"If there is a way to delay an important decision, the good bureaucracy, public or private, will find it." (This was important, I rest my case)

Gresham's Law:

"Trivial matters are handled promptly; important matters are never solved." (this was too important to attend to quickly)

Weinberg's First Law:

"Progress is made on alternate Fridays." (Progress was made on the 4th, thus no progress was made on the weekend of the 11th. This, is absolute and utter proof, I should have led with it.)

Cheops's Law:

"Nothing ever gets built on schedule or within budget." (only the scheduling part of this law need be applied, YFZ took care of the budget.)

Katz's Law:

"Men and nations will act rationally when all other possibilities have been exhausted." (Proof? All other possibilities had been exhausted, and that takes a long time)"

I thank the website "Murphology" for providing such a long list of such laws, complete with appropriate errors, as are necessary.

I say this half (okay, I'm lying, 1/3) humorously. The points are real after the laughing is over.

We are asked to believe, in light of the new evidence I have found, that is largely being ignored, that a bureaucracy, actually at least THREE bureucracies, sprung into action on Sunday, the 13th of April, 2008, communicated effectively and efficiently on that SUNDAY to the point of ultimate resolution. The Texas Rangers called the FBI in San Angelo, on a Sunday, and then they found someone in Colorado Springs' FBI on that Sunday that had no personal connection with the Agent in Texas and no urgency was communicated to him. (Why? Agent Steve A. Smith would remember the name of that Agent in Texas if it was an emergency.)

He then calls in this non urgent state ( The Message will continue to carry with it the tone of no urgency) Sean Mandel (Third Agency) who calls Hugh Velasquez who calls Terry Thrumston and if we're KIND, Terry Thrumston immediately calls back the FIRST UNNAMED FBI Agent in Texas (who's name Agent Steve A. Smith does not recall and apparently did not pass along) and tells him to have Brooks Long "Call me."

Wrong.

The whole point of this humorous post is that information travels slowly in a bureaucracy. It travels even more slowly between them. It travels even more slowly when the message isn't marked "urgent." (See the original warning to Pearl Harbor about the ATTACK.)

The fact is, that once I uncovered this chain of communication, we have to believe it took a long time, relatively speaking. The time frame for discovery of Rozita Swinton stretches backwards towards about March 30th, 2008. It stretches forward to April 13th, 2008. Somewhere in there she was discovered.

Since I have documented a link in the bureaucratic communication that had to be at least the SECOND, not the FIRST investigation into the matter, this means that somewhere in between the 3rd of April and the 11th, they knew. The likelyhood with bureacratic non urgent communications being as they are. (SEE PEARL HARBOR AGAIN) it tood a good deal of time. That means sometime well before the 11th. Probably no later in April than the 6th.
