Arrest David Doran

I said LE knew about Rozita DURING the raid.
The Salt Lake Tribune - "(Texas Ranger Philip) Kemp also found a 90-second call from (Sheriff David) Doran's cell phone to (Rozita) Swinton on April 8, 2008. Doran never told rangers he had the number until Kemp asked him about it.

The Sheriff said he heard only silence in the 90-second call."
Sheriff David Doran withheld material information, during the raid. I contended that LE knew about Rozita DURING, not after the raid, on more than one occasion. I did so after gathering news from personal contacts with the principals in the story.
February 5th, 2009 "Since I have documented a link in the bureaucratic communication that had to be at least the SECOND, not the FIRST investigation into the matter, this means that somewhere in between the 3rd of April and the 11th, they knew. The likelihood with bureaucratic non urgent communications being as they are. (SEE PEARL HARBOR AGAIN) it took a good deal of time. That means sometime well before the 11th. Probably no later in April than the 6th."
Since the date keeps being pushed back, and since the men who tell us it was later, not earlier, and they knew less earlier as opposed to later are men now demonstrated to have lied, bald faced. I think it's fair to say that my fair estimate of "no later than April the 6th, 2008" will be found (eventually) to be more than gracious.

Brooks Long and David Doran have both now been shown to have obstructed justice by withholding or lying (or both) about facts. We cannot believe them about what they knew (being not much) and when they knew it (being much later). We have to doubt it all.

As I have also said about motive, motive becomes important when someone is shown to be lying. A truthful man may have an ulterior motive, but still speaks the truth and his motivations must be discounted if the information is pertinent. An untruthful man must be evaluated in terms of what he might gain from his lying, and his actions must be attributed to those discovered gains.

Brooks and Doran gain entry to YFZ by lying. They hide their criminal activity by lying. They must be assumed to be hiding further criminal activity by lying until they are proved to have done otherwise. Short form? They can't be trusted and must be assumed to have lied about everything. It must be assumed that they will lie again to minimize the damage.

We also now have a real conspiracy. Two or more people plotting against others, using falsehood to gain what they want. That is "an agreement by two or more persons to commit a crime, fraud, or other wrongful act."

It is now CONFIRMED, call to CSPD about Rozita made DURING THE RAID.

Not after, as the lying affidavit in Colorado would have us believe, and as your Modern Pharisee has pounded constantly on the keyboard about, to anyone (read almost no one) that would listen since last year. During the raid. Reading directly from the motion.
"During the course of the search of these premises, a call was made to law enforcement Colorado Springs, Colorado, the area code of the caller's telephone. The first officer contacted recognized the telephone number as that of Rozita Swinton, a 33-year-old African American, single, childless woman, who had been previously convicted and was awaiting trial on charges of false reporting of child abuse in that jurisdiction and was under investigation in jurisdictioins from Washington State to Florida."
I had this story back in January as a result of my own investigative reporting. Texas knew about Rozita DURING the raid. Now we want to know, was it BEFORE as well?

The Non Conspirators continue to not coordinate the non existent plan to destroy the FLDS

It's all in your mind. There is no plan to attack the FLDS on all fronts all at once, you foil hat wearing weirdo. This lawsuit is just another in a long line of coincidences, totally unrelated.
Drain the trust, imprison the leaders, raid the ranch, book after book after book and now sue an FLDS run company for discrimination.
The Deseret News - "Shem Fischer is suing a Hildale cabinet-making shop, claiming that he was unfairly and illegally fired because he and another shop employee were no longer members of the polygamous sect. They were replaced with faithful FLDS members, Fischer's lawsuit against Forestwood Co. says."
Of course all this coordinated picking on is not coordinated and does not represent a conspiracy against a group because of their beliefs but the firing of two employees does.

Flora gets deposed, over Rozita

FLDS attorneys representing Warren Jeffs will be deposing Flora Jessops regarding Rozita Swinton. Good news. If there is anything to discover, let's start discovering;

The Salt Lake Tribune - "Attorney Michael Piccarreta will depose Flora Jessop on Monday and has asked her to bring any recordings of phone calls with Rozita Swinton, law enforcement in Arizona and Texas and child welfare officials in the two states. The summons asks Jessop for any recordings of telephone calls made between March 22 and April 16."


This is very good. Depose. Under oath. Perjury if you lie. I like it. This is one of those big moves that put people on the spot. I don't understand though why phone records were not asked for between Flora and Rozita dating back to the time when she began to make crank phone calls. Probably nothing happens before March of this year, but what if there was a phone call between them? Before that. Inquiring minds would really want to know. More →

Oh, NOW David Foley can be reached for comment.

Always unavailable for comment when it comes to Rozita Swinton, it seems that David Foley isn't too busy. That might have been an excuse he could have used for the frequent but unanswered requests for information on her case, except now he's revealed to be quite the chatterbox. Just pull his string on a favorite subject, making your client out to be a wacko. Here he comments on a murder case, that isn't his. David has also been on the prosecution side of the issue, so apparently he knows a good racket when he sees one.


The Colorado Springs Gazette
- "Defense attorneys not connected to (the first-degree murder case of Earl 'Freddy' Mayes) said the technique is an effective way of letting jurors know what the defendant was going through at the time of the alleged crime without him having to take the stand. Using a mental condition defense might also convince jurors to convict of a lesser offense such as second-degree murder, which is homicide without premeditation, or manslaughter.

'It just gives the defense more room,' said David Foley, a longtime Colorado Springs defense attorney who recently used the mental condition defense for Rozita Swinton, accused of misdemeanor false reporting and making the call that triggered Texas authorities to raid a polygamist compound in April. A decision in the case is pending."


I've said before that Rozita's attorney was awfully high priced legal help for her particular crime. This is a man who is something of a local star in criminal defense and he's studiously avoiding the media in Rozita's case, but readily available to give expert opinion elsewhere.

Why does Rozita, who has had abnormal legal costs in the last several years, who has a mundane average paying job at best, who rents, have this kind of legal help? Who procured David Foley for Ms. Swinton? If memory serves me she did not have his help the last time around when she was in purely local trouble, but when she gets herself into real trouble suddenly she can get real help?

This also points to the defense as a ploy used by a cynical defense attorney. Make her a lunatic. It's easier to defend her that way. How did a lunatic come up with such a good defense attorney, for a misdemeanor? More →

Why did Rozita want to protect children from abuse so badly?

I think she was imitating her Foster Mother, Mary Catharine Nelson who was a case manager for the state of Tennessee's Department of Children's Service. Her former charge Rozita Swinton sent Texas Child Protective Services into YFZ. When newspapers can mention the sad coincidence that Rozita had a court date the same day that her brother Courtney appeared in Nashville on a drug charge, isn't it more relevant to know that her foster mother was obsessed with child safety and worked in the equivalent department of Tennessee state government that attacked the FLDS in Texas?

Do you want to know WHY Rozita Attacked the YFZ
? Find Mary Catharine Nelson, dig there. It's the first LOGICAL spot to do so. Rozita's father is apparently estranged from her. Her mother apparently does not want to talk, but there was a good relationship apparently between her foster mother and Rozita.

Did Mary have a child services/crisis intervention directory of some sort that Rozita took with her? She's called shelters all over the country. Has she been back to Kingston Springs TN since she left after spending time there?

Was there some sort of conspiracy to use Rozita against the YFZ? All conspiracy stories are a bit weak, but some conspiracies have been known to occur. Did for instance Mary Catharine Nelson KNOW Judge Barbara Walthers? Probably not, but they're both United Methodists. Dr. Peggy Ann Way is a close friend of another feminist type who now teaches in Texas. Was there any commerce between Texas CPS and Mary Catharine Nelson? There's only one way to know and that is to ask and look. I suspect strongly that what will be found is who Rozita is connected to, not an active conspiracy involving Mary, but it needs to be looked at. Rozita tells a wild story of abduction that goes through Texas.

If ANYONE wants to know why Rozita did what she did, the logical journey starts in Kingston Springs. It may branch far and wide there, but that's where the trail is. You can trace back from there, you can go forward from there. If you haven't gone there, you don't care. More →

Texas LUSTED after FLDS children, and were selling them probably before the raid.

The evil is beginning to show. I have long suspected and declared that this raid was planned not in response to actual wrong, but because the FLDS had many enemies who desired their demise. I think that will be shown in the end. William Grigg of Pro Libertate digs deep and stares into the eyes of the monster, whose fangs lustfully drip, and whose feet speed to do evil.

"So it's clear that Walther, like most people who wear the habiliments of the judicial profession, is guilty of serious crimes against the Constitution. But she hasn't yet issued an order to 'terminate' the parental rights of the FLDS mothers. The obvious import of the letter cited above is that this development is a foregone conclusion, since provisions have already been made for long-term custodial care for the abducted children by Arrow and other foster care/adoption agencies.


'These children will be in a wonderful Christian environment,' gushes the author of that letter, who goes on to explain that the Arrow Center was in need of volunteers to help clean the facility and perform other routine tasks 'over the next couple of years.' Furthermore, 'it looks like CPS [Child "Protective" Services] is coordinating with the University of Texas to have a charter school on site at the retreat center. This will take place in the fall. Therefore: Arrow will have to build several new buildings for the school.'"


There was a well thought out coordinated plan much like the scene in "Braveheart" where Longshanks has planned in advance a war that might result while he is talking peace. This article makes it look clearly as if several people were "in on it" and had even promised the spoils of children to the lustful arms of a waiting adoption agency. More →
