Eldorado Success gives a Swinton Arrest blow by blow.

The article is very dry, and concentrates on accuracy and chronology.
Among the disclosures is that Ranger Kemp thought Becky Hoerth knew more than she was saying, just like I have surmised.

Candi Shapley figures in Rozita's thinking on the fake phone calls.

She had also obtained a copy of Lynn McFadden's affidavit concerning temporary conservatorship of the over 400 children that CPS was petitioning the court so as to gain custody.

More later. There are quite a few interesting details.

Hugh I can grant you that phones in Rozita's possession were used in making calls and her voice would then be likely recorded, hypothetically. I am not grasping to suggest voice-prints are exonerating but rather why weren't they made? Why not interview Courtney about his phone, he gets the bill?
Yesterday, you never responded to the comment about actions of Ranger Kemp at the apartment, during the arrest & interrogation and forensic lab testing of computer evidence, don't you see the missteps?
Goldstein's efforts during the 'Motion to Suppress' have a larger and ulterior motive, capece`. Mike Picarretta's deposition attempts aimed at Long/Doran ran up against the North Texas Federal Grand Jury, didn't it?

Jam,

I'm not responding to things that are irrelevant. What's important is that Rozita is not truly that bright.

Sneeky? Yah.

Liar? Yup.

Bright? Wouldn't say that.

So when she calls, and muffs every detail, and is in fact the only real candidate for the actual caller, it becomes important to know when they knew her phone number, how she got all that stuff on YFZ and why the decided to believer, among other things.

Long is lying his butt off about Rozita so why is he lying?

Lying by the prosecution is different legally than lying by the defense. It's far more heinous and dangerous to you and me both.

The Pharisee said...

LOL,BELIEVE HER, instead of BELIEVER....

Wow, I'm tired.

Well you're being duped or you are a total fraud when it comes to your stated cause about proper/lawful 'probable cause' and observing Constitutional 'search and seizure' rights. Rozita came home to a search warrant underway and was removed from her apartment and taken to Colorado Springs Police station while Texas Ranger Malone and CSPD Detective Patterson hauled off boxes of 'evidence' for a misdemeanor charge. The 'Eldorado
Success' article that Ranger Kemp was allowed to interview Rozita, in the station, one-on-one conversation after she had requested an attorney? When Rozita refused to give her friends name, CSPD Detective Thurmston came into the room and charged her with the 26 February, 2008 supposed 'Hoax'call, they later added a second charge. Rozita up to that time was told she was to be booked in but not yet charged yet both Kemp/Thurmston had procured the search warrant of her apartmentbased upon a signed misdemeanor warrant. Hugh does the Law mean 'Justice for All'? Then what happens, the computer evidence goes to Texas for forensics. Seems the long arm of the Texas Rangers knows no bounds. Ranger Kemp was allowed to access the apartment, interview a suspect and remove evidence for lab work all based upon his investigation, no arrest/search warrant(s) served.
Our form of Justice is met in a Courtroom and not conviction in a blogger's biased opinion. Rozita was leaned on very heavily, arrested and booked on charges that are set to trial in late August, if a arbitration isn't agreed to first.
I have read your e-mail to Rozita from you stating that you are just seeking the TRUTH, well are you!

Jam,

It may surprise you to know that I think they bungled her arrest. She could get off for that reason.

I suggested that months ago. I'll have to dig up where I said it, it may have been in a private email conversation between what you might call pro FLDS bloggers.

I have no interest per se in seeing Rozita hurt or prosecuted. Bungling her arrest doesn't change what she did and doesn't improve her overall character. It might get her off on charges in Texas.

There's not enough information out there on what happened to Rozita after the police became involved in her case so I can't make an informed judgment.

I've said before too, that I think the FLDS men may be guilty of certain crimes they are charged with, but how the evidence was obtained may weigh heavily on whether or not they should be convicted, or can be.

You are claiming to be a friend of Rozita, you say you've "Seen my email to her," have her email me. I'll tell her side of the story as well.

It won't change my mind in all likelihood that she was the caller, and that as a result, she endangered many lives, but it might color my impression of whether or not certain evidence against her could be used.

Rozita's problem though is that she is on record as possessing those phones in the commission of another misdemeanor earlier in 2008. Those numbers show up on call records in Texas. Improper arrest tactics may only exclude certain statements from being used against her in a trial. There's plenty of other legitimate evidence.

You're wrong about Rozita's role or intentions and triggering the CPS Removal was never an intended act. Do you think the law officials would have dared arrest someone they were conspiring with to trigger a bogus search warrant? Unlike the FLDS Church leaders who have a rumored exclusive deal with 'OPRAH's show, Rozita is not and has not sought the limelight. Why would you think you offer much of anything to her. Right now she has her privacy, has been harassed endlessly and seeks to clear her name from these false and merely circumstantial charges. Allowing the use of your cellular phone, making conference calls and reporting bona-fide information to authorities is not a crime. Flora Jessop spoke to person(s) on several occasions and recorded hours of conversation, she had no suspicions of a 'hoax' and immediately reported the contact to authorities. Are you suggesting that Rozita was able to dupe her and Sam Brower? I don't think so.Isn't that why Mike Picarretta wanted to talk to Sam and Flora, anyway and bring their tapes. I still think the 'Object' is to sneak a peak behind the Federal black-out curtain.

Jam - "You're wrong about Rozita's role or intentions and triggering the CPS Removal was never an intended act."

Role? I don't think so, her call triggered the raid. She made the call. Arsonists often complain they didn't plan to kill anybody when they light a fire.

Jam - "Do you think the law officials would have dared arrest someone they were conspiring with to trigger a bogus search warrant?"

I don't know that the conspiracy preceded the call but it could have, and I don't know if she was involved in it, but her honest answers to certain questions would go a long way to knowing such things.

Jam - "Unlike the FLDS Church leaders who have a rumored exclusive deal with 'OPRAH's show, Rozita is not and has not sought the limelight."

Horsefeathers.

Jam - "Why would you think you offer much of anything to her."

I'm honest that's why. I'd much rather though, that she hiked straight into Rod Parker's office and told him anything he wanted to know, straight up.

Jam - "Right now she has her privacy, has been harassed endlessly and seeks to clear her name from these false and merely circumstantial charges."

Jam, then have her go straight to Rod Parker, it will hasten the day she gets out of the limelight.

Jam - "Allowing the use of your cellular phone, making conference calls and reporting bona-fide information to authorities is not a crime."

Jam, she made the calls. It's her voice, she wasn't "conference calling" when she did that in Colorado, and she wasn't Conference Calling when she stood outside a high school waiting to see what kind of stir she could cause.

Jam - "Flora Jessop spoke to person(s) on several occasions and recorded hours of conversation, she had no suspicions of a 'hoax' and immediately reported the contact to authorities."

There was no one on the phone with Flora other than Rozita.

Jam - "Are you suggesting that Rozita was able to dupe her and Sam Brower? I don't think so."

And I do? I think they used her and threw her away.

Jam - "Isn't that why Mike Picarretta (sic) wanted to talk to Sam and Flora, anyway and bring their tapes. I still think the 'Object' is to sneak a peak behind the Federal black-out curtain."

Piccarreta wants any evidence he can get for obvious reasons.

Sam Brower's opinion of the calls he listen to was 'highly credible' and Flora suggested driving to Colorado Springs, CO to help out in person. Funny offer for someone who later said Rozita was likely a crank caller. The Rangers flew to Colorado to conduct an investigation to apprehend "Sarah", not witness a misdemeanor arrest. If they thought Rozita was just a 'garden variety' hoax caller local authorities and U.S. Marshall's could make the arrest. You do recall that finding "Sarah" was of the greatest necessity on 16 April, 2008. Rozita is not going to walk into Rod Parker's office because, as you have already correctly observed, she has a 'Top Flight' Counselor advising her already. Maybe you should suggest that Dale Evans Barlow contact Matt Smith to schedule his polygraph, instead.

The Pharisee said...

Jam,

Rozita called.

The calls were a complete fabrication, or one so nearly complete as to not matter. I don't care if Rozita "believed" there was someone like Sarah that needed help or not.

You. Are. Grasping. At. Straws.

She called. Nothing else at this time fits the facts that have been supplied.

So true.

In the YFZ raid, I 100% believe there is plenty of information about there to prove the people who planned the call INTENDED TO CAUSE ANOTHER WACO and murder children.

At the minimum they endangered the lives of hundreds of children.

What I want to know is where was the FBI when all of this was going on?

The FBI isn't around to check into teenagers having sex. They are here to protect things like civil rights violations.

Sure Colorado and Texas will let these people go free.

I hope one day there will be someone at the FBI who will bring attempted murder charges against all the players.
